INDIA: Local Registration and Data Storage Mooted for All E-Commerce Platforms

All overseas e-commerce platforms offering products for purchase by local consumers will be obliged to register as business entities within the country should its Draft National e-Commerce Policy be adopted. Additionally, it will be mandatory for all such operators to store all local user data on India-based servers. The policy is now open to public consultation until 9 March.

The proposed measures are seen as a key means of levelling the playing field between e-commerce operators and conventional retailers, as well as between large overseas-based online marketplaces and their local counterparts. Its mooted adopted follows recently-enacted legislation that bans online businesses from selling products from subsidiaries or affiliates.
