China Clarifies Tax Credit and Export VAT Refund Procedures

The State Taxation Administration (STA) recently issued a statement clarifying the required procedures for claiming tax credits and export VAT refunds:

  1. Business taxpayers in the consumer services sector that meet the conditions specified in Announcement No. 87 [2019] – as jointly issued by the Ministry of Finance and the STA – must submit a Statement  of Eligibility for the Enhanced 15% VAT Tax Credit Policy via e-tax webpage (or their local tax office) in order to establish their eligibility in the first instance
  2. Having obtained a Special Customs Bill of Payment of Import VAT (Customs Bill of Payment), general VAT taxpayers may claim tax credit or export VAT refunds by whichever of the below means is applicable:
  • General VAT taxpayers that have obtained a Customs Bill of Payment with information relating to a single VAT payer can then log on to the VAT invoice confirmation platform of their home province (or autonomous region or municipality) in order to begin processing their claim for tax credit or an export VAT refund
  • General VAT payers that have obtained a Customs Bill of Payment with information relating to multiple VAT payers should, in the first instance, upload all such documentation for verification by the tax authorities. They should then log on to the relevant VAT invoice confirmation platform in order to begin processing their claim for tax credit or an export VAT refund

Item 1 above was adopted as of 1 October this year, with Item 2 scheduled to come into force as of 1 February 2020.
