China Steps Up Action on Counterfeit Goods

Counterfeit, substandard and passing off goods are to face tighter control under a range of new measures set to be introduced by the State Administration for Market Regulation. With a particular focus on the medical, food and financial sectors (especially with regard to rural areas, schools and e-commerce sales), this new strategy – as outlined in the Work Plan for a Crackdown on Counterfeit and Inferior Goods in Key Areas (2019-2021) – is intended to enhance the law enforcement capability of market regulators, while raising the overall level of market regulation, by 2021.

Among its primary areas of focus are the following:

  • Rural Markets
    A comprehensive crackdown on counterfeit / substandard food is to be implemented in a number of rural areas, with a particular focus on the investigation and prosecution of those involved with misleading or illegal advertising. At the same time, every effort will be made to strengthen the regulation of advertisements in a number of priority areas, including medical care, pharmaceuticals, food, health foods, finance and investment
  • Food Safety
    The level of health food and infant formula sampling / inspection is to be stepped up, while more robust measures with regard to ensuring food safety in schools, while also improving overall catering quality, are also to be adopted
  • E-Commerce
    Greater priority is to be given to identifying and censuring misleading advertising / promotions, IP infringements and the sale of counterfeit goods / services
  • Certification
    Here there will be enhanced market surveillance effort to crack down on sale of  goods without CCC certification, particularly with regard to small home appliances, children’s goods, electrical items and organic products
