AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Hydrofluorocarbon blends, classified under HTSUS 3824.78.0020 and 3824.78.0050.

Nature of Notice: Final affirmative determination of circumvention in AD investigation A-570-028 , effective 18 March 2020.

Summary: The DOC has determined that imports of unfinished blends of hydrofluorocarbon components R–32 and R–125 from mainland China are circumventing the AD duty order on HFC blends from the mainland. As a result, CBP will continue to suspend liquidation and require a cash deposit of estimated AD duties on subject merchandise that are entered or withdrawn from warehouse on or after 18 June 2019.

Nature of Notice: Postponement of preliminary determination in CV investigation C-570-118 .

Summary : The DOC has decided to postpone its preliminary determination in this investigation from 2 April to 8 June. The preliminary determination will indicate whether the DOC is likely to establish CV duties on imports of subject merchandise.

Product: Electrolytic manganese dioxide, classified under HTSUS subheading 2820.10.0000.

Nature of Notice: Final results of expedited sunset review in AD investigation A-570-919 , effective 20 March 2020.

Summary: The DOC has determined that revocation of this AD duty order would likely lead to continuation or recurrence of dumping. The USITC will proceed with its own investigation to determine whether revocation would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. The order will be extended for an additional five years if the USITC issues an affirmative determination but will be rescinded if the USITC issues a negative determination.

Summary: The DOC has determined that revocation of this CV duty order would likely lead to continuation or recurrence of countervailable subsidisation. The USITC will proceed with its own investigation to determine whether revocation would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. The order will be extended for an additional five years if the USITC issues an affirmative determination but will be rescinded if the USITC issues a negative determination.

Nature of Notice: Rescission of administrative review in AD investigation A-570-910 , effective 23 March 2020.

Summary: The DOC has rescinded its administrative review of subject merchandise exported by 121 companies during the period 1 July 2018 through 30 June 2019 because the petitioner withdrew its review request. As a result, the cash deposit rates for subject merchandise exported by these companies will continue to be the rates established in the most recently completed administrative review.
