New IPR Probe on Child-Resistant Closures. The USITC has instituted an investigation to determine whether imports of certain child-resistant closures with slider devices having a user actuated insertable torpedo for selectively opening the closure and slider devices therefor from mainland China and Japan are violating Section 337 of the 1930 Tariff Act by reason of patent infringement. The complainant requests that after this investigation the USITC issue a general exclusion order (or, alternately, a limited exclusion order) as well as cease and desist orders.

Remedy Comments Sought in IPR Probe of Blood Cholesterol Testing Strips. In its Section 337 investigation of certain blood cholesterol testing strips and associated systems containing the same from mainland China, the USITC has determined to review certain aspects of the final initial determination issued by the presiding administrative law judge and is inviting public comments by 27 August on (i) the form of remedy, if any, that should be ordered if a violation is found, (ii) the effects of any such remedy on the public health and welfare, competitive conditions in the U.S. economy, U.S. production of articles that are like or directly competitive with those that are subject to investigation, and U.S. consumers, and (iii) the amount of the bond under which infringing articles could continue to enter the United States during the 60-day period the president has to review any USITC-ordered remedy. In addition, the target date for the completion of this proceeding has been extended to 21 October.

In its Section 337 investigation of certain earpiece devices and components thereof from various sources, including mainland China, the USITC has determined to review certain aspects of the final initial determination issued by the presiding administrative law judge and is inviting public comments by 28 August on (i) the form of remedy, if any, that should be ordered if a violation is found, (ii) the effects of any such remedy on the public health and welfare, competitive conditions in the U.S. economy, U.S. production of articles that are like or directly competitive with those that are subject to investigation, and U.S. consumers, and (iii) the amount of the bond under which infringing articles could continue to enter the United States during the 60-day period the president has to review any USITC-ordered remedy.

IPR Probe on Semiconductor Devices and Integrated Circuits Amended. The USITC has added two respondents to its Section 337 investigation of certain semiconductor devices, integrated circuits and consumer products containing the same from various sources, including Hong Kong and mainland China.
