CAMBODIA: New Legislation Seeks to Regulate Growing E-Commerce Sector

The country’s parliament has recently approved its Law on E-Commerce, which is intended to regulate the country’s e-commerce sector by introducing an appropriate legal framework and ensuring that digital transactions are conducted in line with international best practices. The new legislation is said to include measures designed to increase consumer protection in business-to-consumer (B2C) transactions and to improve customer protection in business-to-business (B2B) transactions.

In addition, it has also introduced enhanced conditions for regional and international online trade as well as enhanced security for all electronic transactions. The law also specifies procedures for the resolution of disputes resulting from online trading, as well as measures designed to ensure greater compliance with the country’s competition law and data protection rules. The law further introduces measures specifically geared to the taxation of online businesses.

Drafted by Cambodia’s Ministry of Commerce in collaboration with the Asian Development Bank, the new legislation also seeks to help the country’s small and medium enterprises (SMEs) connect with global supply chains, while also promoting technological innovation in the fields of goods and services.
