INDIA: Companies Obliged to Provide Child Care Facilities and Extended Maternity Leave

Companies with more than 50 workers will now have to provide child-care facilities under the terms of the proposed Maternity Benefit (Amendment) Bill. The legislation also extends maternity leave from 12 to 26 weeks in certain circumstances.

The 26-week leave period will be open to female staff with only one surviving child and who work in companies with 10 or more employees. For the first time, adopting mothers and those whose biological child is to be delivered by a surrogate mother will also qualify for a 12-week period of maternity leave. In the case of child-care facilities, companies with 50 or more staff will have the option of providing a dedicated on-site facility or of arranging a shared facility with other companies.

Having already passed through the initial consultancy stages, the bill is expected to be enacted before the end of the year.
