THAILAND: Extended Maternity Leave and Increased Severance Pay Promised for 2019
The statutory maternity leave period is to be extended to 98 days from its current level of 90, although any time off taken for medical checks prior to delivery may be deducted from this total. In terms of liabilities for payments, this will be split evenly between the employer and the state Social Security Fund, with each party obliged to cover 45 days of the salary due over the leave period.
The changes, which come as part of recent amendments to Thailand’s Labour Protection Act, are expected to be implemented in early 2019. This will coincide with the formal adoption of other regulatory requirements specified in the revised Act, including a rise in the statutory severance pay for workers who have been continuously employed by the same business for a minimum of 20 years. In this instance, their mandatory pay-off will rise from the equivalent of 300 days of current salary to 400.
