China Announces First Exclusion from Second Batch of Additional Tariffs on US Imports
A trade tariff exclusions on 65 items of US imports has been announced, in effect for one year from 28 February 2020.
The exclusions were revealed in the State Council Customs Tariff Commission’s Announcement Concerning the First Set of Exclusions from the Second Batch of Additional Tariffs on US Imports, issued on18 February (Announcement No. 3 ). It states that review of valid applications has been organised and a decision has been made on the first set of exclusions from the second batch of additional tariffs on US imports. The exclusions will be implemented in two separate lists with effect from 28 February 2020.
- For products on List 1 of the Announcement Appendix (55 items in total), Section 301 countermeasure tariffs will be suspended from 28 February 2020 to 27 February 2021 (one year). Tariffs that have already been levied will be refunded. The affected import enterprises can apply for refunds from Customs within six months from the exclusion list announcement date.
- For products on List 2 of the Announcement Appendix (10 items in total), tariffs will be suspended for the same period, but tariffs that have already been levied will not be refunded.
The exclusions are pursuant to the Announcement of the Customs Tariff Commission of the State Council on the Trial Implementation of the Exclusion of US Products Subject to Additional Tariffs (Announcement No. 2 ).
The Commission will continue to work on the exclusion process and release the exclusion list of US goods subject to additional tariffs in due course.
