China Issues App Stores Record Filing Rules

The Cyberspace Administration of China (CAC) has recently released a circular, instructing its offices across the country to implement the record filing procedure of mobile internet applications (app) stores from 16 January 2017.

A CAC spokesperson said that keeping records of internet app stores is to press them to perform their roles, impose stricter supervision and promote the healthy and orderly development of the mobile internet. Focus is on three matters for application. First, app stores applying for carrying out business operation; second, changes of record filing details; and third, cancellation of record filing for cease of business.

The CAC spokesperson said that the lack of sound regulations, substandard management, the pursuit of the largest listings of apps in their store to maximise economic return, and insufficient supervision and gatekeeping give rise to apps spreading information that violates laws and regulations, jeopardising users’ legitimate right, and with security hazards to the strong resentment to members of the public.

Record filing of internet app stores is an important step and key link to implement the Provisions on the Administration of Mobile Internet Applications (Apps) Information Services allowing basic work in mobile internet management to be in place and regulating the app store industry. 

According to the circular, internet app stores are required to submit application in paper form and e-materials for record to local CAC offices where their ICP records are kept or business permits are issued. All CAC offices should strictly examine the record information and provide record consulting services. App stores failing to file the information, provide false information, or carry out illegal operation will be investigated and punished according to the law and regulations. CAC will strengthen the supervision and inspection of the record filing work, grasp the basic situation and industry base of app stores, timely organise and provide a central enquiry service, and maintain an open record of app stores for public access.
