China Postpones Additional US Tariffs Until 31 March 2019

Additional tariffs on US imports to China are to be suspended following a meeting between the leaders of the two countries. As a consequence, the proposed tariff increases on 211 categories of US goods have been put on hold by the State Council's Customs Tariff Commission for a three-month period commencing 1 January 2019.

The move follows the trade war truce that broke out in the wake of a meeting between Xi Jinping, the Chinese President, and Donald Trump, his US counterpart, during the recent Buenos Aires G20 Summit. In accordance with the Foreign Trade Law of the People's Republic of China, the Import and Export Tariff Regulations of the People’s Republic of China and the basic principles of international law, this has seen three tranches of mooted tariff impositions postponed until at least 31 March 2019.

The three affected tranches are as follows:

  • The additional tariffs of 25% to be imposed on 28 categories listed in Appendix 1 of The Customs Tariff Commission Announcement on Levying Additional Tariffs on US$50 Billion Worth of US Goods (Customs Tariff Commission Announcement No. 5 [2018]).
  • The additional tariffs of 25% to be imposed on 116 categories listed in Appendix 2 of The Customs Tariff Commission Announcement on Levying Additional Tariffs on US$16 Billion Worth of US Goods (Customs Tariff Commission Announcement No. 7 [2018]).
  • The additional tariffs of 5% to be imposed on 67 categories listed in Appendix 3 of The Customs Tariff Commission Announcement on Levying Additional Tariffs on US$60 Billion Worth of US Goods (Customs Tariff Commission Announcement No. 8 [2018]).
