China Updates Catalogue of Dual-Use Items and Technologies

China’s Ministry of Commerce and the General Administration of Customs recently issued an updated Catalogue of Dual-Use Items and Technologies Subject to Import and Export Licence Administration (MOFCOM and GAC Announcement No. 68 [2019]).

Taking effect from 1 January, 2020, the Catalogue is divided into two parts: namely, a Catalogue of Dual-Use Items and Technologies Subject to Import Licence Administration (covering chemicals capable of being used as chemical weapons, substances that can be used for making drugs, and radioactive isotopes), and a Catalogue of Dual-Use Items and Technologies Subject to Export Licence Administration (covering nuclear materials and equipment, biological dual-use items and related equipment, and chemicals capable of being used as chemical weapons).

Those intending to import or export dual-use items and technologies listed in the Catalogue, must apply for the relevant import or export licence in accordance with law, regardless of whether customs commodity codes are stipulated in the Catalogue.
