China’s Big Three Telcos Pledge to Enforce Phone User Real-name Registration

Recently, China’s “Big Three” basic telecom service operators have signed the undertaking under which they pledge to strictly enforce the real-name registration of phone users as required by the Ministry of Industry and Information Technology (MIIT). The three operators have agreed that subsidiaries and persons responsible at all levels found in violation of real-name registration requirements will be strictly held accountable in accordance with laws and regulations.

The three basic telecom service operators undertake to comply with the requirements of China’s laws and regulations and those of the MIIT in strengthening their internal management as well as the supervision and management of their commissioned agent channels. They are also charged with improving their technology and measures in order to strictly carry out their work in the real-name registration of phone users. They have to ensure meeting the various targets in real-name registration set out in an MIIT directive on implementation measures to further prevent and combat telecommunications fraud (the MIIT Directive).

At the same time, within individual enterprises, actions in violation of laws and regulations on real-name registration of phone users will be dealt with in accordance with the requirements laid down in a circular jointly issued by MIIT and five other ministries/commissions on the prevention and combating of fraud using the telecommunications network (the Circular). For minor violations, the province or city concerned will be reprimanded publicly and required to carry out rectification within a fixed period. For serious violations, the person accountable in the province or city concerned will be given a warning, a demerit or a major demerit or other administrative disciplinary measures while being required to effectively supervise telecom enterprises at all levels in carrying out real-name registration of phone users.

Next, MIIT will redouble its supervision and inspection efforts to see to it that the “Big Three” basic telecom service operators will effectively carry out the measures laid down in the phone user real-name registration undertaking, strictly implement the various requirements in the real-name registration of phone users, to earnestly safeguard the legitimate rights and interests of the users, and to promote the sustained, healthy development of the industry.
