China’s Construction Sector Subject to New Ozone Depletion Regime

Construction projects that produce/consume ozone-depleting substances (ODS) are now subject to a raft of new regulations introduced by the Ministry of Environmental Protection (MEP). The new regulationsoutlined in the Circular on Work Relating to the Administration of Construction Projects that Produce or Consume Ozone Depleting Substances have been designed to strengthen the oversight of ODS and to ensure compliance with the Montreal Protocol on Substances that Deplete the Ozone Layer, an international environmental protection treaty.

Overall, the guidelines address two specific project types:

1) Construction Projects Involving Controlled Substances:

All construction projects producing or consuming ODS ­– whether through the use of refrigerants, foaming agents, extinguishing agents, solvents, cleaning agents, processing agents, aerosols, soil fumigants or on account of any other controlled application ­– are prohibited. In the case of rebuilding or relocating-related construction projects where controlled ODS levels are produced, increasing the ODS production capacity is forbidden.

2) Construction Projects Involving Non-Controlled Petrochemical or Carbon Tetrachloride Substances (or their By-products):

In the case of construction projects that produce ODS in a petrochemical or carbon tetrachloride form, any ODS produced can only be used as a raw material for downstream industrial products by the construction company concerned. They cannot be used as refrigerants, foaming agents, solvents or in any other controlled applications, neither can they be sold overseas or discharged indiscriminately.

The new regulations came into force as of 24 January this year.
