Environmental Protection Tax Law Set for 2018 Implementation Following End of Public Consultation

The public consultation process with regard to the proposed Implementation Rules of the Environmental Protection Law of the PRC was scheduled to finish on 26 July this year. Subsequent to this, The Environmental Protection Law of the PRC, as ratified by the Standing Committee of the National People’s Congress at the end of 2016, will come into force on 1 January 2018.

From that date forth, any body proven to have discharged pollutants into the environment will be obliged to pay a punitive environmental protection tax. The exact sum levied will be in accordance with the following guidelines:

  • Air pollutants: RMB1.2-RMB12 per pollutant equivalent value
  • Water pollutants: RMB1.4-RMB14 per pollutant equivalent value
  • Solid waste: RMB5-RMB1,000 per ton
  • Noise: RMB350-RMB11,200 per month

The consultation period was jointly managed by The Ministry of Finance, The State Administration of Taxation and The Ministry of Environmental Protection.
