Guangdong Announces Schedule for Overhaul of Pollutant Discharge System

A timeline for the overhaul of the Pollutant Discharge Permit system and the implementation of new regulations relating to stationary pollution sources has been issued by the Guangdong Environmental Protection Department.

According to the Department, these new requirements will be subject to a three-stage adoption schedule:

2018

The application for and issue of Pollutant Discharge Permits must be completed in the following industrial sectors: petrochemical, agricultural (including food processing), ceramics, brick, iron, steel and non-ferrous metals

2019

The application for and issue of Pollutant Discharge Permits will continue in line with state requirements for all designated industrial sectors

2020

The application for and issue of Pollutant Discharge Permits must be completed for all stationary pollution sources within the remit of the Catalogue of Classified Management of Pollutant Discharge Permits for Stationary Pollution Sources (2017 Version) (Order No. 45 of the Ministry of Environmental Protection).

In accordance with Article 6 of the Provisions on the Administration of Pollutant Discharge Permits (Trial Implementation) (Order No. 48 of the Ministry of Environmental Protection), issuing Pollutant Discharge Permits is the responsibility of the prevailing city-level Environmental Protection Department (including Dongguan and Zhongshan) with jurisdiction over the operational location of any polluting entity.

These new measures will be effective from 1 September 2018 to 31 December 2020. Throughout that period, all polluting entities must comply with their environmental protection obligations and only discharge pollutants within the legal parameters of their permits. It is also incumbent upon them to maintain comprehensive accounts of all such activity and to accurately report, at specified intervals, on their compliance with the terms of their Pollutant Discharge Permits.
