New Regulatory Regime Introduced for Online Catering Businesses
As of 1 January 2018, all online catering businesses will be obliged to comply with a series of new regulations issued by the China Food and Drug Administration (CFDA). Billed as Administrative Measures for the Supervision of Food Safety in Online Catering Services, the three primary requirements are as follows:
- In line with the principle of online and offline catering businesses complying with the same regulatory regime, all such online companies must operate from their own designated premises and be in receipt of the requisite food business licences. Furthermore, their activities shall be restricted solely to those operations specified under the terms of said licences.
- In the case of online third-party catering service platforms, they are required to implement all of the statutory food safety procedures, including establishing a dedicated department to oversee the management of all food safety protocols. At the same time, online businesses are additionally obliged to disclose all information relating to their raw materials upon request, while also formulating and implementing an appropriate regime for the oversight of such materials.
- With regard to delivery personnel, they are required to maintain a high level of personal hygiene and to use only safe and hazard-free delivery containers, while ensuring that all food remains uncontaminated while in transit.
