Online Unconditional Refund Takes Effect on 15 March

The State Administration for Industry and Commerce (SAIC) earlier issued the Interim Measures for the Seven-Day Unconditional Return of Online Purchased Goods (see Measures in Chinese), which shall come into force on 15 March 2017. The Measures stipulate that online sellers of goods shall have the obligation of offering buyers seven-day unconditional return of goods in accordance with law, but specify that seven categories of online purchased goods are not eligible for seven-day unconditional returns, including:

(1)   Custom-made goods ordered by buyer;

(2)   Fresh or perishable goods;

(3)   Audio-visual products downloaded or unsealed by buyer and digital products like computer software;

(4)   Newspapers and periodicals delivered.  

Also, the provisions for seven-day unconditional returns shall not apply to goods of the following nature confirmed by buyer at the time of purchase:

(1)Goods that are likely to affect people’s safety or health once unsealed, or goods whose quality may change once unsealed;

(2)Goods that will lose value substantially once activated or tried; and

(3)Goods that have been clearly marked with imminent use-by dates or defects notification at the time of sale.

The returned goods must be intact. Goods are deemed to be intact if their original quality and functions are kept and the main item(s), accessories and trademark labels are complete. Opening the packages for inspection or reasonable testing for inspection of quality and function should not affect the intactness of the goods.
