Registration and Update Procedures for Foreign-Invested Businesses Revised

In order to streamline the record maintenance procedures relating to the registration of foreign-invested enterprises (FIEs), the Ministry of Commerce (MOFCOM) has recently issued the Decision to Amend the Interim Measures for the Record-Filing Administration of the Establishment and Change of FIES.

The primary changes introduced were as follows:

  • When registering the establishment of an FIE with administration departments for market regulation, the investor’s representative/authorised agent shall also fulfill the record-filing requirements via online submission at the same time.
  • When the status of a commercial organisation is changed to FIE due to merger and acquisition activities, as well as informing administration departments for market regulation, the investor’s representative/authorised agent shall also fulfill the corresponding record-filing requirements via online submission at the same time.

These amendments took effect as of 30 June 2018.
