Stringent Anti-Soil Pollution Measures Set for January 2019 Implementation
New legislation aimed at reducing the level of pollution found in soil, while promoting its sustainable use, was adopted by the 13th National People’s Congress Standing Committee during its fifth plenary session. These revised requirements – The Soil Pollution Prevention and Control Law – specify that a legally-compliant environmental impact assessment must be conducted prior to the formal approval of any land use or construction project deemed to be potentially soil-polluting.
Furthermore, the Law also makes it explicit that any entity or individual that produces, uses, stores, transports, recycles, disposes of or discharges toxic/hazardous substances must take effective measures to prevent any leakages, loss or spills that may result in soil pollution.
This new legislation comes into force as of 1 January 2019.
