Thresholds of Hong Kong / Guangdong GBA Legal Partnership Association Requirements Lowered

The Guangdong Department of Justice has made it clear that only Hong Kong or Macao-headquartered solicitor firms can establish partnership associations with their Guangdong counterparts under the terms of the Outline Development Plan for the Guangdong-Hong Kong-Macao Greater Bay Area. But certain thresholds have been lowered with effect from 1 August this year. These include that any proposed Guangdong partner business must employ more than 20 practising lawyers. This figure has, however, been reduced from the 30 specified in the previously applicable requirements. Moreover, the minimum 30% shareholding applicable to Hong Kong and Macao partners has been scrapped.

Full details of these new arrangements can be found in the Interim Measures of the Department of Justice of Guangdong Province on Hong Kong Law Firms and Macao Law Firms Operating in the Form of Partnership Associations with Mainland Law Firms in Guangdong Province (2019 Revision).
