Action: The Official Journal has published a corrigendum to Commission Implementing Regulation 2018/49 of 11 January 2018 amending Council Implementing Regulation 501/2013 following a ‘new exporter’ review. On the Contents page and on page 31, in the title of the regulation, the corrigendum states that for: ‘Commission Implementing Regulation (EU) 2018/49 of 11 January 2018 amending Council Implementing Regulation (EU) No 501/2013 following a “new exporter” review pursuant to Articles 11(4) and 13(4) of Regulation (EU) 2016/1036 of the European Parliament and of the Council’, one should read: ‘Commission Implementing Regulation (EU) 2018/49 of 11 January 2018 amending Council Implementing Regulation (EU) No 501/2013 extending the definitive anti-dumping duty imposed by Implementing Regulation (EU) No 990/2011 on imports of bicycles originating in the People's Republic of China to imports of bicycles consigned from, inter alia, Tunisia, whether declared as originating in, inter alia, Tunisia or not, following a “new exporter” review pursuant to Article 11(4) and 13(4) of Regulation (EU) 2016/1036 of the European Parliament and of the Council’.

Commodity: Hand pallet trucks and their essential parts, i.e. chassis and hydraulics, currently falling within CN codes ex 8427 90 00 and ex 8431 20 00 (TARIC codes 8427900013 and 8431200013).

Action: On 22 February 2018, the Official Journal published Commission Implementing Regulation 2018/260 terminating the investigation concerning the possible circumvention of anti-dumping measures imposed by Council Implementing Regulation 1008/2011, as amended by Implementing Regulation 372/2013, on imports of hand pallet trucks and their essential parts originating in the Chinese mainland by imports consigned from Vietnam, whether declared as originating in Vietnam or not. On 6 June 2017, the Commission received a request to investigate the possible circumvention of the anti-dumping measures imposed. The request was lodged by two Union producers of hand pallet trucks and their essential parts, Toyota Material Handling Manufacturing Sweden AB and PR Industrial S.r.l. (‘the applicants’). The request contained sufficient prima facie evidence on a change in the pattern of trade between the Union, the Chinese mainland and Vietnam which appeared to stem from a practice, process or work for which there was insufficient due cause or economic justification other than the imposition of the duty, namely the consignment of the product concerned via Vietnam to the Union after having undergone assembly operations in Vietnam. The investigation was initiated by Commission Implementing Regulation 2017/1348. In view of the Commission’s findings mentioned in recitals 30 to 32 of Commission Implementing Regulation 2018/260, the anti-circumvention investigation has been terminated. The registration of imports has also been discontinued, and Commission Implementing Regulation 2017/1348 has been repealed.
