Anti-dumping Actions

Commodity: ‘Bicycle parts’, as defined by Article 1 of Commission Regulation 88/97, namely, bicycle parts and accessories falling within CN codes 8714 91 10 to 8714 99 90. As for ‘essential bicycle parts’, these are defined in Article 1 of Council Regulation 71/97.
Countries/Economies: The Chinese mainland.
Action: The Official Journal has published a corrigendum to Commission Implementing Decision 2015/2362 of 15 December 2015 concerning exemptions from the extended anti-dumping duty on certain bicycle parts originating in the Chinese mainland pursuant to Regulation 88/97 (see: Business Alert-EU, Issue 25/2015 for details of the Commission Implementing Decision). In that Decision, on page 36, in Article 5, Table 4 ‘Parties under examination’, in column ‘Date of effect’, for company ‘CICLI EUROPA s.r.l’: for ‘10.9.2014’, one should read ‘10.11.2014’.
Dates: The corrigendum was published on 12 March 2016.

Commodity: Crystalline silicon photovoltaic modules and key components (i.e. cells) as further described in Article 1 of Implementing Regulations 1238/2013  and 1239/2013.
Countries/Economies: The Chinese mainland.
Action: The Official Journal has published a notice concerning the definitive anti-dumping and countervailing duties imposed on imports of the product concerned. The notice concerns the change of name of one company subject to an individual anti-dumping duty rate and an individual countervailing duty rate. Years Solar Co. Ltd informed the Commission that it has changed its name into LERRI Solar Technology (Zhejiang) Co. Ltd. The company asked the Commission to confirm that the change of name does not affect the right of the company to benefit from the individual duty rates applied to the company under its previous name of Years Solar Co. Ltd. The Commission has examined the information supplied and concluded that the change of name in no way affects the findings of Implementing Regulations 1238/2013 and 1239/2013 imposing, respectively, the anti-dumping and countervailing duties on imports of the product concerned. Therefore, the reference in Annex I to each of the Regulations to Years Solar Co. Ltd – TARIC additional code B898 should be read as LERRI Solar Technology (Zhejiang) Co. Ltd – TARIC additional code B898. The TARIC additional code B898, previously attributed to Years Solar Co. Ltd shall apply to LERRI Solar Technology (Zhejiang) Co. Ltd.

Action: The Official Journal has published a notice concerning the definitive anti-dumping and countervailing duties imposed on imports of the product concerned. The notice concerns the change of name of one company subject to an individual anti-dumping duty rate and an individual countervailing duty rate. The undertaking offered in the framework of an anti-dumping and an anti-subsidy proceedings concerning imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the Chinese mainland was accepted by Commission Implementing Decision 2013/707/EU. Years Solar Co. Ltd, a company subject to an individual anti-dumping duty rate of 41.3%, following Implementing Regulation 1238/2013 and to an individual countervailing duty rate of 6.4% following Implementing Regulation 1239/2013, informed the Commission that it has changed its name into LERRI Solar Technology (Zhejiang) Co. Ltd. The company asked the Commission to confirm that the change of name does not affect the right of the company to benefit from the individual duty rates applied to the company under its previous name of Years Solar Co. Ltd. The Commission has examined the information supplied and concluded that the change of name in no way affects the findings of Implementing Decision 2013/707/EU. Therefore, the reference in the Annex of Implementing Decision 2013/707/EU to Years Solar Co. Ltd – TARIC additional code B898 should be read as LERRI Solar Technology (Zhejiang) Co. Ltd – TARIC additional code B898. The TARIC additional code B898, previously attributed to Years Solar Co. Ltd shall apply to LERRI Solar Technology (Zhejiang) Co. Ltd.
