Anti-dumping Actions

Commodity: Imports of hand pallet trucks and their essential parts, i.e. chassis and hydraulics, currently falling within CN codes ex 8427 90 00 (TARIC codes 8427900011 and 8427900019) and ex 8431 20 00 (TARIC codes 8431200011 and 8431200019), extended to the same product but presented at import with a so-called ‘weight indication system’ consisting of a weighing mechanism not integrated in the chassis, that is to say not integrated in the forks, currently falling within TARIC codes 8427900030 and 8431200050.

Countries/Economies: The Chinese mainland.

Action: The Official Journal has published a corrigendum to Commission Implementing Regulation 2016/1346 extending the definitive anti-dumping duty imposed by Council Implementing Regulation 1008/2011, as amended by Council Implementing Regulation 372/2013, on imports of hand pallet trucks and their essential parts originating in the Chinese mainland to imports of slightly modified hand pallet trucks originating in the Chinese mainland. On page 10, in Article 1(1), the following wording exists: ‘The definitive anti-dumping duty imposed by Implementing Regulation (EU) No 372/2013 on imports of hand pallet trucks and their essential parts, i.e. chassis and hydraulics, currently falling within CN codes ex 8427 90 00 (TARIC codes 8427900011 and 8427900019) and ex 8431 20 00 (TARIC codes 8431200011 and 8431200019), originating in the People's Republic of China is extended to the same product but presented at import with a so-called ‘weight indication system’ consisting of a weighing mechanism not integrated in the chassis, currently falling within TARIC codes 8427900030 and 8431200050.’. This wording has now been replaced with the following: ‘The definitive anti-dumping duty imposed by Implementing Regulation (EU) No 372/2013 on imports of hand pallet trucks and their essential parts, i.e. chassis and hydraulics, currently falling within CN codes ex 8427 90 00 (TARIC codes 8427900011 and 8427900019) and ex 8431 20 00 (TARIC codes 8431200011 and 8431200019), originating in the People's Republic of China is extended to the same product but presented at import with a so-called ‘weight indication system’ consisting of a weighing mechanism not integrated in the chassis, that is to say not integrated in the forks, currently falling within TARIC codes 8427900030 and 8431200050.’.

Countries/Economies: The Chinese mainland.

Action: On 2 August 2017, the Official Journal published Commission Implementing Regulation 2017/1408 withdrawing the acceptance of the undertaking for two exporting producers under Implementing Decision 2013/707/EU. The latter Decision confirms the acceptance of an undertaking offered in connection with the anti-dumping and anti-subsidy proceedings concerning imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the Chinese mainland for the period of application of definitive measures. In accordance with the basic anti-dumping and anti-subsidy Regulations and also in accordance with the terms of the undertaking, the Commission has concluded that the acceptance of the undertaking for BLD Solar and Topray Solar should be withdrawn. Accordingly, the definitive anti-dumping duty and the definitive countervailing duty automatically apply to imports originating in or consigned from the Chinese mainland of the product concerned and produced by Topray Solar and BLD Solar as of the day of entry into force of the new Regulation. The table in the Annex II to the new Regulation lists the exporting producers for whom the acceptance of the undertaking by Implementing Decision 2013/707/EU is not affected.

Dates: Commission Implementing Regulation 2017/1408 entered into force on the day following that of its publication in the Official Journal.
