Summary: The DOC has preliminarily established the following dumping margin for imports of subject merchandise during the period 1 January through 30 June 2015. The DOC will instruct CBP to begin collecting AD cash deposits on imports of subject merchandise at this rate. If both the DOC and the USITC issue affirmative final determinations in this case, the DOC will issue an AD duty order and require AD cash deposits at the rate specified therein, which could be different from that set forth below.

The DOC has also preliminarily determined that critical circumstances exist with respect to imports of subject merchandise from the China-wide entity. As a result, CBP will be instructed to impose provisional measures retroactively on subject goods from this entity up to 90 days prior to publication of the preliminary determination.

Summary: The USITC on 18 September 2015 determined that revocation of this AD duty order would likely lead to continuation or recurrence of material injury to an industry in the U.S. within a reasonably foreseeable time. Accordingly, the DOC has extended the order for an additional five years.

Summary: The DOC has preliminarily established the following dumping margins for imports of subject merchandise during the period 1 February 2014 through 31 January 2015. If these results are finalised, CBP will assess AD duties on all appropriate entries using these rates, which will also be used to determine new AD cash deposit requirements. CBP will not assess AD duties or impose cash deposit requirements on entries subject to a zero rate.

Summary: The DOC has determined that revocation of this AD duty order would likely lead to continuation or recurrence of dumping. The USITC will proceed with its own investigation to determine whether revocation would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. The order will be extended for an additional five years if the USITC issues an affirmative determination but will be rescinded if the USITC issues a negative determination.

Summary: The scope of these investigations includes stainless steel sheet and strip, whether in coils or straight lengths. Stainless steel is an alloy steel containing by weight 1.2 percent or less of carbon and 10.5 percent or more of chromium, with or without other elements. The subject sheet and strip is a flat-rolled product with a width greater than 9.5 mm and a thickness of 0.3048 mm and greater but less than 4.75 mm, that is annealed or otherwise heat treated and pickled or otherwise descaled. Subject sheet and strip may also be further processed (e.g., cold-rolled, annealed, tempered, polished, aluminised, coated, painted, varnished, trimmed, cut, punched or slit) provided that it maintains the specific dimensions of sheet and strip set forth above. Products are covered regardless of shape and include products of either rectangular or non-rectangular cross-section where such cross-section is achieved subsequent to the rolling process (i.e., products that have been “worked after rolling”).

Subject merchandise includes stainless steel sheet and strip that has been further processed in a third country, including cold-rolling, annealing, tempering, polishing, aluminising, coating, painting, varnishing, trimming, cutting, punching and/or slitting, or any other processing that would not otherwise remove the merchandise from the scope of the investigations if performed in the country of manufacture of the stainless steel sheet and strip. Excluded from the scope are: (i) sheet and strip that is not annealed or otherwise heat treated and not pickled or otherwise descaled; (ii) plate (i.e., flat-rolled stainless steel products of a thickness of 4.75 mm or more); and (iii) flat wire (i.e., cold-rolled sections with a mill edge, rectangular in shape, of a width of not more than 9.5 mm).

The USITC is scheduled to issue a preliminary injury determination in these investigations on 25 March.

Nature of Notice: Court decision not in harmony with final scope ruling and amended final scope ruling in AD investigation A-570-890, effective 10 March 2016.

Summary: In May 2014, the DOC issued a final scope ruling where it determined that certain chests were subject to the AD duty order on subject merchandise. However, following certain voluntary remand and U.S. Court of International Trade proceedings the DOC determined that these chests do not fall within the scope of the order. As a result, the DOC will instruct CBP to set a cash deposit rate of zero for the four chests in question. If the CIT’s ruling is not appealed or is upheld on appeal, the DOC will instruct CBP to liquidate entries of subject merchandise and lift suspension of liquidation on such entries.

Summary: The DOC has published the following list of scope rulings completed between 1 July and 30 September 2015. Scope rulings serve to determine whether a particular product is within the scope of an AD duty order. Scope issues typically arise in cases where the descriptions of subject merchandise contained in the DOC’s determinations are ambiguous. It is also possible that, as technology evolves and new products are created, these new products may fall outside the scope of the order.
