Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.
Product: Certain tool chests and cabinets, classified under HTSUS subheadings 7326.90.3500, 7326.90.8688, 9403.20.0021, 9403.20.0026 and 9403.20.0030.
Nature of Notice: Initiation of AD investigation A-570-056 and CV investigation C-570-057, effective 9 May 2017.
Summary: The scope of these investigations covers certain metal tool chests and tool cabinets with drawers. This includes all metal tool chests and cabinets, including top chests, intermediate chests, tool cabinets and side cabinets, storage units, mobile work benches and work stations with the following physical characteristics: (1) a body made of carbon, alloy or stainless steel and/or other metals; (2) two or more drawers for storage in each individual unit; (3) a width (side to side) exceeding 15 inches for side cabinets and exceeding 21 inches for all other individual units, but not exceeding 60 inches; (4) a drawer depth (front to back) exceeding 10 inches but not exceeding 24 inches; and (5) pre-packaged for retail sale.
For purposes of the scope, the width parameter applies to each individual unit (i.e., each individual top chest, intermediate top chest, tool cabinet, side cabinet, storage unit, mobile work bench and work station). Pre-packaged for retail sale means the units are packaged in a cardboard box or other container suitable for retail display and sale. Subject tool chests and cabinets are covered whether imported in assembled or unassembled form. They include merchandise produced in mainland China but assembled, pre-packaged for sale or subject to other minor processing in a third country prior to importation into the United States. Similarly, the scope would include tool chests and cabinets produced in mainland China that are later found to be assembled, pre-packaged for sale or subject to other minor processing after importation into the United States.
Subject tool chests and cabinets may also have doors and shelves in addition to drawers, may have handles (typically mounted on the sides) and may have a work surface on the top. They may be uncoated (e.g., stainless steel), painted, powder coated, galvanised, or otherwise coated for corrosion protection or aesthetic appearance. They may be packaged as individual units or in sets. When packaged in sets, they typically include a cabinet with one or more chests that stack on top of the cabinet.
Excluded from the scope of these investigations are tool boxes, chests and cabinets with bodies made of plastic, carbon fibre, wood or other non-metallic substances. Also excluded from the scope are portable metal tool boxes with the following characteristics: (1) fewer than three drawers; (2) a handle on the top that allows the tool box to be carried by hand; and (3) a width that is 21 inches or less and depth (front to back) not exceeding 10 inches. Also excluded from the scope are industrial grade steel tool chests and cabinets, namely those having a body that is over 60 inches wide or having each of the following physical characteristics: (1) a body made of steel that is 0.055 inches or more in thickness; (2) all drawers over 21 inches deep; (3) all drawer slides rated for 200 pounds or more; and (4) not pre-packaged for retail sale.
Also excluded from the scope are work benches with fewer than two drawers. Excluded work benches have a solid top working surface, fewer than two drawers, are supported by legs, and have no solid front, side or back panels enclosing the body of the unit. Metal filing cabinets configured to hold hanging file folders that are classified under subheading 9403.10.0020 are also excluded from the scope.
The USITC will issue its preliminary injury determination by 26 May (a vote has been scheduled for 25 May).

Nature of Notice: Initiation of administrative reviews of AD duty orders, effective 9 May 2017.
Summary: The DOC has initiated separate administrative reviews of the following AD duty orders: certain tissue paper products (A-570-894) – period of review 1 March 2016 through 28 February 2017; glycine (A-570-836) – POR 1 March 2016 through 28 February 2017; and small diameter graphite electrodes (A-570-929) – POR 1 February 2016 through 31 January 2017. These reviews are scheduled to be completed by 31 March 2018 and could result in (a) revised AD duty assessments for entries of subject merchandise made during the applicable period of review and (b) revised AD duty cash deposit rates for entries made after completion of the review.
Product: Sulfanilic acid, classified under HTSUS subheadings 2921.42.22 and 2921.42.90.
Nature of Notice: Continuation of AD duty order A-570-815, effective 9 May 2017.
Summary: The USITC determined on 28 March that revocation of the AD duty order on subject merchandise would likely lead to continuation or recurrence of material injury to an industry in the U.S. within a reasonably foreseeable time. Accordingly, the DOC has extended the order for an additional five years.
Product: Certain activated carbon, classified under HTSUS subheading 3802.10.00.
Nature of Notice: Court decision not in harmony with final results and amended final results of administrative review in AD investigation A-570-904, effective 7 May 2017.
Summary: The DOC has amended the final results of its administrative review of subject merchandise for the period 1 April 2009 through 31 March 2010 after the U.S. Court of International Trade sustained its final remand redetermination. As a result, the DOC has assigned an amended weighted-average dumping margin of zero percent to Ningxia Huahui Activated Carbon Company Ltd. However, because there have been subsequent administrative reviews for this company the cash deposit rate will remain the US$1.36/kg rate published in the most recently completed review.

Nature of Notice: Final results and partial rescission of administrative review in CV investigation C-570-971, effective 15 May 2017.
Summary: The DOC has established the followings subsidy rates for imports of subject merchandise during the period 1 January through 31 December 2014. CBP will assess CV duties on all appropriate entries using these rates, which will also be used to determine new CV cash deposit requirements.

Product: Certain cold-drawn mechanical tubing of carbon and alloy steel, classified under HTSUS subheadings 7304.31.3000, 7304.31.6050, 7304.51.1000, 7304.51.5005, 7304.51.5060, 7306.30.5015, 7306.30.5020, 7306.50.5030, 7306.30.1000 and 7306.50.1000.
Nature of Notice: Initiation of AD investigation A-570-058 and CV investigation C-570-059, effective 16 May 2017.
Summary: The scope of these investigations covers cold-drawn mechanical tubing of carbon and alloy steel of circular cross-section, in actual outside diameters less than 331 mm, and regardless of wall thickness, surface finish, end finish or industry specification. The subject merchandise is a tubular product with a circular cross-sectional shape that has been cold-drawn or otherwise cold-finished after the initial tube formation in a manner that involves a change in the diameter or wall thickness of the tubing, or both. It may be produced from either welded (e.g., electric resistance welded, continuous welded, etc.) or seamless (e.g., pierced, pilgered or extruded, etc.) carbon or alloy steel tubular products. It may also be heat treated after cold working. Such heat treatments may include annealing, normalising, quenching and tempering, stress relieving or finish annealing. Typical cold-drawing methods for subject merchandise include drawing over mandrel, rod drawing, plug drawing, sink drawing and similar processes that involve reducing the outside diameter of the tubing with a die or similar device, whether or not controlling the inside diameter of the tubing with an internal support device such as a mandrel, rod, plug or similar device.
Subject merchandise is typically certified to meet industry specifications for cold-drawn tubing including: (1) American Society for Testing and Materials or American Society of Mechanical Engineers specifications ASTM A–512, ASTM A–513 Type 3 (ASME SA513 Type 3), ASTM A–513 Type 4 (ASME SA513 Type 4), ASTM A–513 Type 5 (ASME SA513 Type 5), ASTM A–513 Type 6 (ASME SA513 Type 6), ASTM A–519 (cold-finished); (2) SAE International (Society of Automotive Engineers) specifications SAE J524, SAE J525, SAE J2833, SAE J2614, SAE J2467, SAE J2435, SAE J2613; (3) Aerospace Material Specification AMS T–6736 (AMS 6736), AMS 6371, AMS 5050, AMS 5075, AMS 5062, AMS 6360, AMS 6361, AMS 6362, AMS 6371, AMS 6372, AMS 6374, AMS 6381, AMS 6415; (4) United States Military Standards MIL–T–5066 and MIL–T–6736; (5) foreign standards equivalent to one of the previously listed ASTM, ASME, SAE, AMS or MIL specifications including but not limited to: (i) German Institute for Standardisation (DIN) specifications DIN 2391–2, DIN 2393– 2, DIN 2394–2); (ii) European Standards EN 10305–1, EN 10305–2, EN 10305–4, EN 10305–6 and European national variations on those standards (e.g., British Standard (BS EN), Irish Standard (IS EN) and German Standard (DIN EN) variations, etc.); (iii) Japanese Industrial Standard JIS G 3441 and JIS G 3445; and (vi) proprietary standards that are based on one of the above-listed standards.
The subject cold-drawn mechanical tubing may also be dual or multiple certified to more than one standard. Pipe that is multiple certified as cold-drawn mechanical tubing and to other specifications not covered by this scope is also covered by the scope of these investigations when it meets the physical description set forth above. Steel products included in the scope of these investigations are products in which (1) iron predominates, by weight, over each of the other contained elements; and (2) the carbon content is two percent or less by weight. For purposes of this scope, the place of cold-drawing determines the country of origin of the subject merchandise. Subject merchandise that is subject to minor working in a third country that occurs after drawing in one of the subject countries, including heat treatment, cutting to length, straightening, non-destruction testing, deburring or chamfering, remains within the scope of the investigations. All products that meet the written physical description are within the scope of these investigations unless specifically excluded or covered by the scope of an existing order.
Merchandise that meets the physical description of cold-drawn mechanical tubing above is within the scope of the investigations even if it is also dual or multiple certified to an otherwise excluded specification listed below. The following products are outside of, and/or specifically excluded from, the scope of these investigations: (1) cold-drawn stainless steel tubing containing 10.5 percent or more of chromium by weight and not more than 1.2 percent of carbon by weight; and (2) products certified to one or more of the following ASTM, ASME or American Petroleum Institute specifications: ASTM A–53; ASTM A–106; ASTM A–179 (ASME SA 179); ASTM A–192 (ASME SA 192); ASTM A–209 (ASME SA 209); ASTM A–210 (ASME SA 210); ASTM A–213 (ASME SA 213); ASTM A–334 (ASME SA 334); ASTM A–423 (ASME SA 423); ASTM A–498; ASTM A–496 (ASME SA 496); ASTM A–199; ASTM A–500; ASTM A–556; ASTM A–565; API 5L; and API 5CT except that any cold-drawn tubing product certified to one of the above excluded specifications will not be excluded from the scope if it is also dual- or multiple-certified to any other specification that otherwise would fall within the scope of these investigations.
The USITC will issue its preliminary injury determination by 5 June (a vote has been scheduled for 2 June).
Product: Steel wire garment hangers, classified under HTSUS subheadings 7326.20.0020 and 7323.99.9060.
Nature of Notice: Court decision not in harmony with final results and amended final results of administrative and new shipper reviews in AD investigation A-570-918, effective 1 May 2017.
Summary: The DOC has amended the final results of its administrative and new shipper reviews of subject merchandise for the period 1 October 2011 through 30 September 2012 after the CIT sustained its final remand redetermination. As a result, the DOC has assigned an amended weighted-average dumping margin of 40.39 percent to subject merchandise produced by Hangzhou Qingqing Mechanical Co. Ltd. and exported by Hangzhou Yingqing Material Co. Ltd. Because there is now a final court decision, this dumping margin will apply from 1 May.

Nature of Notice: Postponement of preliminary determination in CV investigation C-570-054, effective 17 May 2017.
Summary: The DOC has decided to postpone its preliminary determination in this investigation from 1 June to 7 August. The preliminary determination will indicate whether the DOC is likely to establish CV duties on imports of subject merchandise.

Nature of Notice: Amended final affirmative determination and issuance of AD duty order A-570-045, effective 18 May 2017.
Summary: The DOC has amended its final affirmative determination to correct certain ministerial errors. Additionally, it has issued an AD duty order and has instructed CBP to collect AD cash deposits on imports of subject merchandise at the following amended rates.
