AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Cast iron soil pipe fittings, classified under HTSUS subheading 7307.11.0045.
Nature of Notice: Preliminary affirmative determination and alignment of final CV and AD determinations in CV investigation C-570-063, effective 19 December 2017.

Summary: The DOC has preliminarily established the following subsidy rates for imports of subject merchandise. The DOC will instruct CBP to begin collecting CV cash deposits on imports of subject merchandise at these rates. If both the DOC and the USITC issue affirmative final determinations in this case, the DOC will issue a CV duty order and require CV cash deposits at the rates specified therein, which could be different from those set forth below.

The DOC has also aligned the final determinations in the AD and CV investigations of subject merchandise so that they are both issued on 24 April.

Product: Diamond sawblades and parts thereof, classified under HTSUS subheadings 6804.21.0000,  8202.39.0000 and 8206.00.0000.
Nature of Notice: Final results of changed circumstances review in AD investigation A-570-900, effective 19 December 2017.

Summary: The DOC has determined that Chengdu Huifeng New Material Technology Co. Ltd. is the successor-in-interest to Chengdu Huifeng Diamond Tools Co. Ltd. for purposes of determining AD duty liability. Accordingly, the DOC will instruct CBP to assign entries of subject merchandise exported by the predecessor company the cash deposit rate applicable to the successor company effective from the date of publication of the final results.

Product: Crystalline silicon photovoltaic cells, whether or not assembled into modules, classified under HTSUS subheadings 8501.31.8000, 8501.61.0000, 8507.20.80, 8541.40.6020 and 8541.40.6030.
Nature of Notice: Preliminary results of changed circumstances review and intent to partially revoke AD and CV duty orders in AD investigation A-570-979 and CV investigation C-570-980, effective 26 December 2017.

Summary: The DOC has preliminarily determined that these orders should be revoked with respect to certain solar panels of a sufficiently small size, voltage, amperage and wattage, among other characteristics. Specifically, if the preliminary determination is finalised the orders would exclude panels with a surface area from 3,450 mm2 to 33,782 mm2, with one black wire and one red wire (each of type 22 AWG or 24 AWG not more than 206 mm in length when measured from panel extrusion), and not exceeding 2.9 volts, 1.1 amps and 3.19 watts. No panel would be able to contain an internal battery or external computer peripheral ports.
