Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Certain steel wheels 12 to 16.5 inches in diameter, classified under HTSUS subheadings 7326.90.8688, 9403.20.0080, 9403.90.8041, 7308.90.3000, 7308.90.6000, 7308.90.9590 and 9403.20.0090.

Summary: The scope of these investigations covers certain on-the-road steel wheels, discs and rims for tubeless tyres with a nominal wheel diameter of 12 inches to 16.5 inches, regardless of width. Subject wheels are generally for road and highway trailers and other towable equipment, including utility trailers, cargo trailers, horse trailers, boat trailers, recreational trailers and towable mobile homes. The standard widths of subject wheels are 4 inches, 4.5 inches, 5 inches, 5.5 inches, 6 inches and 6.5 inches, although all subject wheels are covered by the scope. The scope includes rims and discs for subject wheels, whether imported as an assembly, unassembled or separately. Subject wheels are included regardless of steel composition, whether cladded or not cladded, whether finished or not finished, and whether coated or uncoated. Also included are subject wheels with discs in either a “hub-piloted” or “stud-piloted” mounting configuration, although the stud-piloted configuration is most common in the size range covered.

All on-the-road wheels sold in the United States must meet Standard 110 or 120 of the National Highway Traffic Safety Administration’s Federal Motor Vehicle Safety Standards, which require a rim marking (such as the “DOT” symbol) indicating compliance with applicable motor vehicle standards. The scope includes subject wheels imported with or without NHTSA’s required markings. Subject wheels imported as an assembly with a tyre mounted on the wheel and/or with a valve stem or rims imported as an assembly with a tyre mounted on the rim and/or with a valve stem are included in the scope. However, if the steel wheels or rims are imported as an assembly with a tyre mounted on the wheel or rim and/or with a valve stem attached, the tyre and/or valve stem is not covered by the scope.

The following wheels are excluded from the scope: (1) steel wheels for use with tube-type tyres (such tyres use multi piece rims, which are two-piece and three-piece assemblies and require the use of an inner tube); (2) aluminium wheels; (3) certain on-the-road steel wheels that are coated entirely with chrome; and (4) steel wheels that do not meet Standard 110 or 120 of the NHTSA’s requirements other than the rim marking requirements found in 49 CFR 571.110S4.4.2 and 571.120S5.2.

The USITC will issue its preliminary injury determination by 24 September (a vote has been scheduled for 21 September).

Summary: The DOC has amended the scope of its preliminary affirmative determination on subject merchandise by revising part b) of clause 4 in paragraph 5 and excluding certain shredded plastic film or shredded plastic strip from the investigation.

Summary: The DOC has preliminarily determined that critical circumstances exist for the mandatory respondents Graceful Imp. & Exp. Co. Ltd., Moyoung Trading Co. Ltd. and Ningbo Syloon Imp & Exp Co. Ltd. but do not exist for all other exporters or producers. The DOC has also revised the scope of its preliminary affirmative determination in response to comments from various interested parties.

Summary: The DOC has preliminarily established the following dumping margin for imports of subject merchandise. The DOC will instruct CBP to begin collecting AD cash deposits on imports of subject merchandise at this rate. If both the DOC and the USITC issue affirmative final determinations in this case, the DOC will issue an AD duty order and require AD cash deposits at the rate specified therein, which could be different from that set forth below.

Summary: The DOC has determined that the cash deposit rate for the 21 exporters/producers who retain a separate rate assigned in the original AD investigation should be recalculated to reflect the revised CV duty export subsidy offsets from the amended final CV determination. CBP will assess CV duties on all appropriate entries using these rates, which will also be used to determine new CV cash deposit requirements.

Summary: The DOC has initiated separate administrative reviews of the following AD duty orders for the period 1 July 2017 through 30 June 2018: carbon steel butt-weld pipe fittings (A-570-814), circular welded carbon quality steel pipe (A-570-910) and xanthan gum (A-570-985). The DOC has also launched a review of the AD duty order on tapered roller bearings (A-570-601) for the period 1 June 2017 through 31 May 2018 as well as the CV duty orders on circular welded carbon quality steel pipe (C-570-911) and certain oil country tubular goods (C-570-944) for the period 1 January through 31 December 2017. These reviews are scheduled to be completed by 31 July 2019 and could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the applicable period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the review.

Summary: Each year during the anniversary month of the publication of an AD/CV duty order, finding or suspension of investigation, an interested party may request that the DOC conduct an administrative review of that particular action. The DOC is now giving interested parties the opportunity to request, by 1 October, administrative reviews of the AD duty orders on the following products from mainland China for the period 1 September 2017 through 31 August 2018: freshwater crawfish tail meat (A-570-848), foundry coke (A-570-862), kitchen appliance shelving and racks (A-570-941), lined paper products (A-570-901), magnesia carbon bricks (A-570-954), narrow woven ribbons with woven selvedge (A-570-952), new pneumatic off-the-road tyres (A-570-912), raw flexible magnets (A-570-922) and steel concrete reinforcing bars (A-570-860). Parties may also request reviews of the following CV duty orders for the period 1 January through 31 December 2017: kitchen appliance shelving and racks (C-570-942), magnesia carbon bricks (C-570-955), narrow woven ribbons with woven selvedge (C-570-953), new pneumatic off-the-road tyres (C-570-913) and raw flexible magnets (C-570-923). These reviews could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the reviews.
