AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Crystalline silicon photovoltaic cells, whether or not assembled into modules, classified under HTSUS subheadings 8501.31.8000, 8501.61.0000, 8507.20.80, 8541.40.6020 and 8541.40.6030.

Nature of Notice: Final results and partial rescission of administrative review in CV investigation C-570-980, effective 28 August 2019.

Summary: The DOC has established the following subsidy rates for imports of subject merchandise during the period 1 January through 31 December 2016. CBP will assess CV duties on all appropriate entries using these rates, which will also be used to determine new CV cash deposit requirements.

Product: Laminated woven sacks, classified under HTSUS subheadings 3923.21.0080, 3923.21.0095, 3923.29.0000, 3917.39.0050, 3921.90.1100, 3921.90.1500, 4601.99.0500, 4601.99.9000, 4602.90.0000, 5903.90.2500, 6305.33.0050 and 6305.33.0080.

Nature of Notice: Continuation of AD duty order A-570-916 and CV duty order C-570-917, effective 28 August 2019.

Summary: The USITC determined on 2 August that revocation of the AD and CV duty orders on subject merchandise would likely lead to continuation or recurrence of material injury to an industry in the U.S. within a reasonably foreseeable time. Accordingly, the DOC has extended the orders for an additional five years.

Product: Persulfates, classified under HTSUS subheadings 2833.40.20, 2833.40.50 and 2833.40.60.

Nature of Notice: Continuation of AD duty order A-570-847, effective 28 August 2019.

Summary: The USITC determined on 2 August that revocation of the AD duty order on subject merchandise would likely lead to continuation or recurrence of material injury to an industry in the U.S. within a reasonably foreseeable time. Nature of Notice: Final results of expedited sunset review in CV investigation C-570-915, effective 30 August 2019.

Summary: The DOC has determined that revocation of this CV duty order would likely lead to continuation or recurrence of countervailable subsidisation. The USITC will proceed with its own investigation to determine whether revocation would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. The order will be extended for an additional five years if the USITC issues an affirmative determination but will be rescinded if the USITC issues a negative determination.

Product: Monosodium glutamate, classified under HTSUS subheadings 2922.42.1000, 2922.42.5000, 2103.90.7200, 2103.90.7400, 2103.90.7800, 2103.90.8000 and 2103.90.9091.

Nature of Notice: Preliminary results of administrative review in AD investigation A-570-992, effective 30 August 2019.

Summary: In its review of subject merchandise for the period 1 November 2017 through 31 October 2018, the DOC has preliminarily determined that none of the 28 companies subject to the review have demonstrated their eligibility for a separate rate. If these results are finalised, these companies will be considered part of the China-wide entity, subject to a 40.41 percent AD rate.

Nature of Notice: Upcoming sunset reviews of AD duty order A-570-992 and CV duty order C-570-991.

Summary: The DOC has announced that separate sunset reviews of the AD duty order on monosodium glutamate and the CV duty order on chlorinated isocyanurates will be initiated in October. The reviews will result in either the revocation or continuation of the orders.

Product: Certain steel wheels 12 to 16.5 inches in diameter, classified under HTSUS subheadings 8716.90.5035 and 8716.90.5059.

Nature of Notice: Issuance of AD and CV duty orders in investigations A-570-090 and C-570-091, effective 3 September 2019.

Nature of Notice: Opportunity to request administrative reviews of AD/CV duty orders, effective 2 August 2019.

Summary: Each year during the anniversary month of the publication of an AD/CV duty order, finding or suspension of investigation, an interested party may request that the DOC conduct an administrative review of that particular action. The DOC is now giving interested parties the opportunity to request, by 30 September, administrative reviews of the AD duty orders on the following products from mainland China for the period 1 September 2018 through 31 August 2019: foundry coke (A-570-862), kitchen appliance shelving and racks (A-570-941), lined paper products (A-570-901), magnesia carbon bricks (A-570-954), narrow woven ribbons with woven selvedge (A-570-952), raw flexible magnets (A-570-922) and steel concrete reinforcing bars (A-570-860). Parties may also request a review of the AD duty order on freshwater crawfish tail meat (A-570-848) for the period 1 September 2018 through 15 May 2019, the AD duty order on new pneumatic off-the-road tyres (A-570-912) for the period 1 September 2018 through 3 February 2019, and the CV duty orders on kitchen appliance shelving and racks (C-570-942), magnesia carbon bricks (C-570-955), narrow woven ribbons with woven selvedge (C-570-953) and raw flexible magnets (C-570-923) for the period 1 January through 31 December 2018. These reviews could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the reviews.
