AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Utility scale wind towers, classified under HTSUS subheadings 7308.20.0020 and 8502.31.0000.

Nature of Notice: Rescission of administrative review in AD investigation A-570-981, effective 4 September 2019.

Summary: The DOC has rescinded its administrative review of subject merchandise exported by 56 companies during the period 1 February 2018 through 31 January 2019 based on the timely withdrawal of the review request. As a result, the cash deposit rates for subject merchandise from these companies will continue to be the rates established in the most recently completed administrative review.

Product: 1-hydroxyethylidene-1, 1-diphosphonic acid, classified under HTSUS subheadings 2811.19.6090, 2931.90.9041 and 2931.90.9043.

Summary: The DOC has rescinded its administrative review of subject merchandise exported by Henan Qingshuiyuan Technology Co. Ltd., Nantong Uniphos Chemicals Co. Ltd. and Nanjing University of Chemical Technology Changzhou Wujin Water Quality Stabilizer Factory during the period 1 May 2018 through 30 April 2019 based on the timely withdrawal of the review request. Nature of Notice: Postponement of preliminary determination in AD investigation A-570-108.

Summary: The DOC has decided to postpone its preliminary determination in this investigation from 17 September to 6 November. The preliminary determination will indicate whether the DOC is likely to establish AD duties on imports of subject merchandise.

Nature of Notice: Initiation of administrative reviews of AD/CV duty orders, effective 9 September 2019.

Summary: The DOC has initiated separate administrative reviews of the following AD duty orders for the period 1 July 2018 through 30 June 2019: certain cold-rolled steel flat products (A-570-029), carbon steel butt-weld pipe fittings (A-570-814), circular welded carbon quality steel pipe (A-570-910), corrosion-resistant steel products (A-570-026) and xanthan gum (A-570-985). The DOC has also launched reviews of the AD duty orders on aluminium extrusions (A-570-967) for the period 1 May 2018 through 30 April 2019 and monosodium glutamate (A-570-992) for the period 1 November 2017 through 31 October 2018, as well as the CV duty orders on aluminium extrusions (C-570-968), certain cold-rolled steel flat products (C-570-030), circular welded carbon quality steel pipe (C-570-911) and corrosion-resistant steel products (C-570-027) for the period 1 January though 31 December 2018, and the CV duty order on cold-drawn mechanical tubing (C-570-059) for the period 25 September 2017 through 31 December 2018. These reviews are scheduled to be completed by 31 July 2020 and could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the applicable period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the review.

Summary: The DOC has rescinded its administrative review of subject merchandise exported by Shandong Taihe Chemicals Co. Ltd., Shandong Taihe Water Treatment Technologies Co. Ltd. and Henan Qingshuiyuan Technology Co. Ltd. during the period 1 January through 31 December 2018 based on the timely withdrawal of the review request. As a result, the cash deposit rates for subject merchandise from these companies will continue to be the rates established in the most recently completed administrative review.

Product: Refined brown aluminium oxide, classified under HTSUS subheading 2818.10.2000.

Nature of Notice: Initiation of sunset review of AD duty order A-570-882,  effective 10 September 2019.

Summary: The DOC has initiated a sunset review of the AD duty order on subject merchandise from mainland China. The review will result in either the revocation or continuation of the order.

Product: Certain fabricated structural steel, classified under HTSUS subheadings 7308.90.3000, 7308.90.6000, 7308.90.9590, 7216.91.0010, 7216.91.0090, 7216.99.0010, 7216.99.0090, 7222.40.6000, 7228.70.6000, 7301.10.0000, 7301.20.1000, 7301.20.5000, 7308.40.0000, 7308.90.9530 and 9406.90.0030.

Nature of Notice: Preliminary affirmative determination and postponement of final determination in AD investigation A-570-102, effective 10 September 2019.

Summary: The DOC has preliminarily established the following dumping margins for imports of subject merchandise. The DOC will instruct CBP to begin collecting AD cash deposits on imports of subject merchandise at these rates. If both the DOC and the USITC issue affirmative final determinations in this case, the DOC will issue an AD duty order and require AD cash deposits at the rates specified therein, which could be different from those set forth below. CBP will not assess AD duties or impose cash deposit requirements on entries subject to a zero rate.

The DOC has also postponed its deadline for a final determination in this investigation until 23 January 2020 and extended the provisional measures from a four-month period to a period no greater than six months.
