AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Carbon steel butt-weld pipe fittings, classified under HTSUS subheading 7307.93.30.

Nature of Notice: Final affirmative determination of circumvention inquiry in AD investigation A-570-814, effective 21 July 2019.

Summary: The DOC has determined that certain imports of carbon steel butt-weld pipe fittings exported from Malaysia, which were completed in Malaysia using finished or unfinished butt-weld pipe fittings sourced from mainland China, are circumventing the AD duty order on subject merchandise from the mainland. The DOC will direct CBP to continue to suspend liquidation and require a cash deposit of estimated duties on unliquidated entries of subject merchandise that were entered or withdrawn from warehouse for consumption on or after 21 August 2017, the date of initiation of the anti-circumvention inquiry.

Summary: The DOC has established the following subsidy rates for imports of subject merchandise. If the USITC issues a final affirmative injury determination in this case, the DOC will issue a CV duty order and instruct CBP to collect CV cash deposits on imports of subject merchandise at the following rates.

Nature of Notice: Postponement of preliminary determination in CV investigation C-570-109.

Summary: The DOC has decided to postpone its preliminary determination in this investigation from 5 July to 6 September. The preliminary determination will indicate whether the DOC is likely to establish CV duties on imports of subject merchandise.

Nature of Notice: Partial rescission of administrative review in AD investigation A-570-863, effective 24 June 2019.

Summary: The DOC has rescinded based on the timely withdrawal of the review request its administrative review of subject merchandise exported by Inner Mongolia Komway Import & Export Co. Ltd. and Shenzhen Long Sheng Shang Mao Ltd. during the period 1 December 2017 through 30 November 2018. As a result, the cash deposit rates for subject merchandise from these companies will continue to be the rates established in the most recently completed administrative review. The review will continue with respect to Jiangsu Runchen Agricultural/Sideline Foodstuff Co. Ltd.

Nature of Notice: Amended final scope ruling in AD investigation A-570-967 and CV investigation C-570-968, effective 25 June 2019.

Summary: In August 2014, the DOC issued a final scope ruling where it determined that certain kitchen appliance door handles with plastic end caps were subject to the scope of these orders. Specifically, the DOC found that the handles did not fall under the finished merchandise or finished goods kit exclusions based on its interpretation of these exclusions. Following a legal challenge, the DOC issued a first amended final scope ruling finding that the handles were not covered by the scope of the orders. However, following an appeal by a domestic petitioner and certain ensuing court proceedings the DOC has determined that the extruded aluminium components of the subject handles are within the scope of the orders while the non-extruded aluminium components are outside the scope of the orders.
