Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.
Product: Certain amorphous silica fabric, classified under HTSUS subheadings 7019.59.4021, 7019.59.4096, 7019.59.9021, 7019.59.9096, 7019.40.4030, 7019.40.4060, 7019.40.9030, 7019.40.9060, 7019.51.9010, 7019.51.9090, 7019.52.9010, 7019.52.9021, 7019.52.9096 and 7019.90.1000.
Nature of Notice: Initiation of AD investigation A-570-038 and CV investigation C-570-039, effective 23 February 2016.
Summary: The scope of these investigations includes woven (whether from yarns or rovings) industrial grade amorphous silica fabric, which contains a minimum of 90 percent silica by nominal weight and a
nominal width in excess of eight inches. Included within the scope is industrial grade amorphous silica fabric regardless of other materials contained in the fabric, whether in roll form or cut-to-length, regardless of weight, width (except as noted above) or length. The investigations cover silica fabric regardless of whether the product is approved by a standards testing body or meets any governmental specification. Industrial grade amorphous silica fabric may be produced in various colours and is covered regardless of whether it is coloured. It may be coated or treated with materials that include oils, vermiculite, acrylic latex compound, silicone, aluminised polyester (Mylar®) film, pressure-sensitive adhesive, or other coatings and treatments. Silica fabric is covered regardless of whether it is coated or treated, regardless of coating or treatment weight as a percentage of total product weight, and regardless of whether the fabric is heat-cleaned.
Subject merchandise may be imported in rolls or cut-to-length and then further fabricated to make welding curtains, welding blankets, welding pads, fire blankets, fire pads or fire screens. Regardless of the name, all industrial grade amorphous silica fabric that has been further cut-to-length or cut-to-width or further finished by finishing the edges and/or adding grommets is included within the scope of these investigations. Subject merchandise also includes any industrial grade amorphous silica fabric that has been converted into such fabric in mainland China from fibreglass cloth produced in a third country as well as silica fabric that has been further processed in a third country prior to export to the United States, including treating, coating, slitting, cutting to length, cutting to width, finishing the edges, adding grommets, or any other processing that would not otherwise remove the merchandise from the scope of the investigations if performed in the country of manufacture.
Excluded from the scope is amorphous silica fabric that is subjected to controlled shrinkage, which is also called “pre-shrunk” or “aerospace grade” amorphous silica fabric. In order to be excluded as a pre-shrunk or aerospace grade amorphous silica fabric the fabric must meet the following exclusion criteria:
- contain a minimum of 98 percent silica by nominal weight;
- have an areal shrinkage of four percent or less;
- contain no coatings or treatments; and
- be white in colour.
The term “areal shrinkage” refers to the extent to which a specimen of amorphous silica fabric shrinks while subjected to heating at 1,800 º F for 30 minutes. Also excluded from the scope are amorphous silica fabric rope and tubing (or sleeving). Amorphous silica fabric rope is a knitted or braided product made from amorphous silica yarns, while silica tubing (or sleeving) is braided into a hollow sleeve from amorphous silica yarns.
The USITC on 4 March issued a preliminary affirmative injury determination on imports of subject merchandise. As a result, the DOC will carry out its AD and CV duty investigations.
Product: Crystalline silicon photovoltaic cells, whether or not assembled into modules, classified under HTSUS subheadings 8501.61.0000, 8507.20.80, 8541.40.6020, 8541.40.6030 and 8501.31.8000.
Nature of Notice: Final results of changed circumstances review in AD investigation A-570-979, effective 25 February 2016.
Summary: The DOC has determined that Neo Solar Power Corporation is not the successor-in-interest to DelSolar Co. Ltd., an exporter assigned a producer/exporter rate in the original AD investigation. As a result, Neo Solar will be subject to the cash deposit rate currently assigned to the China-wide entity (i.e., 238.95 percent).
Product: Lorry and bus tyres, classified under HTSUS subheadings 4011.20.1015, 4011.20.5020, 4011.99.4520, 4011.99.4590, 4011.99.8520, 4011.99.8590, 8708.70.4530, 8708.70.6030 and 8708.70.6060.
Nature of Notice: Initiation of AD investigation A-570-040 and CV investigation C-570-041, effective 25 February 2016.
Summary: The scope of these investigations covers new pneumatic rubber tyres with a lorry (truck) or bus size designation. Covered lorry and bus tyres may be tube-type, tubeless, radial or non-radial. Subject tyres have at the time of importation the symbol “DOT” on the sidewall, certifying that the tyre conforms to applicable motor vehicle safety standards. Subject tyres may also have one of the following suffixes in their tyre size designation, which also appears on the sidewall of the tyre:
- TR — identifies tyres for service on lorries or buses to differentiate them from similarly sized passenger car and light truck tyres;
- MH — identifies tyres for mobile homes; and
- HC — identifies a 17.5 inch rim diameter code for use on low platform trailers.
All tyres with a “TR,” “MH” or “HC” suffix in their size designation are covered by these investigations regardless of their intended use. In addition, all tyres that lack one of the above suffix markings are included in the scope regardless of their intended use as long as the tyre is of a size that is among the numerical size designations listed in the “Truck-Bus” section of the Tire and Rim Association Year Book, unless the tyre falls within one of the specific exclusions set out below.
Lorry and bus tyres are included in the scope whether or not they mounted on wheels or rims. However, if a subject tyre is imported mounted on a wheel or rim only the tyre is covered by the scope. Subject merchandise includes lorry and bus tyres produced in the subject country whether mounted on wheels or rims in the subject country or a third country. The tyres are covered whether or not they are accompanied by other parts (e.g., a wheel, rim, axle parts, bolts, nuts, etc.)
Lorry and bus tyres that enter attached to a vehicle are not covered by the scope of these proceedings. Also excluded are pneumatic rubber tyres that are not new, including recycled and retreaded tyres, as well as non-pneumatic tyres such as solid rubber tyres.
The USITC is scheduled to issue a preliminary injury determination in these investigations on 11 March.

Nature of Notice: Upcoming sunset reviews of AD duty order A-570-967 and CV duty order C-570-968.
Summary: The DOC has announced that sunset reviews of these AD and CV duty orders will be initiated in April. The reviews will result in either the revocation or continuation of the orders.

Nature of Notice: Initiation of sunset reviews of AD duty orders A-570-814 and A-570-893, effective 1 March 2016.
Summary: The DOC has initiated separate sunset reviews of the orders on frozen warm water shrimp and carbon steel butt-weld pipe fittings. The reviews will result in either the revocation or continuation of the orders.

Nature of Notice: Opportunity to request administrative reviews of AD/CV duty orders, effective 1 March 2016.
Summary: Each year during the anniversary month of the publication of an AD/CV duty order, finding or suspension of investigation, an interested party may request that the DOC conduct an administrative review of that particular action. The DOC is now giving interested parties the opportunity to request, by 31 March, administrative reviews of the AD duty orders on the following products from mainland China for the period 1 March 2015 through 29 February 2016: chloropicrin (A-570-002), circular welded austenitic stainless pressure pipe (A-570-930), glycine (A-570-836), sodium hexametaphosphate (A-570-908) and tissue paper products (A-570-894). Parties may also request a review of the CV duty order on circular welded austenitic stainless pressure pipe (C-570-931) for the period 1 January through 31 December 2015. These reviews could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the reviews.

Nature of Notice: Initiation of administrative reviews of AD/CV duty orders, effective 3 March 2016.
Summary: The DOC has initiated separate administrative reviews of the following AD duty orders: fresh garlic (A-570-831) – period of review 1 November 2014 through 31 October 2015; multi-layered wood flooring (A-570-970) – POR 1 December 2014 through 30 November 2015; potassium permanganate (A-570-001) – POR 1 January through 31 December 2015; and wooden bedroom furniture (A-570-970) – POR 1 January through 31 December 2015. The DOC has also launched a review of the CV duty order on calcium hypochlorite (C-570-009) for the period 27 May 2014 through 13 December 2015. These reviews are scheduled to be completed by 31 January 2017 and could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the applicable period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the review.

Nature of Notice: Issuance of AD duty order A-570-022 and CV duty order C-570-023, effective 3 March 2016.
Summary: The USITC issued on 9 February a final affirmative AD and CV injury determination in its investigation of subject merchandise. Accordingly, the DOC has issued AD and CV duty orders and has instructed CBP to collect AD and CV cash deposits on imports of subject merchandise at the following rates.

Nature of Notice: Initiation and preliminary results of changed circumstances review in AD investigation A-570-900, effective 3 March 2016.
Summary: The DOC has preliminarily determined that Wuhan Wanbang Laser Diamond Tools Co. Ltd. is the successor-in-interest to Wuhan Wanbang Laser Diamond Tools Co. If these preliminary results are confirmed, the DOC will instruct CBP to assign entries of subject merchandise exported by the first company the cash deposit rate applicable to the second company effective from the date of publication of the final results.
Product: Calcium hypochlorite, classified under HTSUS subheadings 2828.10.0000, 3808.94.5000 and 3808.99.9500.
Nature of Notice: Initiation of new shipper review in CV investigation C-570-009, effective 4 March 2016.
Summary: The DOC has initiated a new shipper review of subject merchandise produced by Haixing Eno Chemical Co. Ltd. and exported by Haixing Jingmei Chemical during the period 27 May 2014 through 31 December 2015. The review will indicate whether the DOC is likely to establish a separate CV rate for this producer/exporter combination.
Product: Certain activated carbon, classified under HTSUS subheading 3802.10.00.
Nature of Notice: Preliminary results of administrative review in AD investigation A-570-904, effective 4 March 2016.
Summary: The DOC has preliminarily established the following dumping margins for imports of subject merchandise during the period 1 April 2014 through 31 March 2015. If these results are finalised, CBP will assess AD duties on all appropriate entries using these rates, which will also be used to determine new AD cash deposit requirements.
