AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Glycine, classified under HTSUS subheading 2922.49.4020.
Nature of Notice: Initiation of administrative reviews of AD duty order A-570-836, effective 2 May 2016.

Summary: The DOC has initiated an administrative review of the AD duty order on glycine for the period 1 March 2015 through 29 February 2016. This review is scheduled to be completed by 31 March 2017 and could result in (a) revised AD duty assessments for entries of subject merchandise made during the applicable POR and (b) revised AD duty cash deposit rates for entries made after completion of the review.

Nature of Notice: Upcoming sunset reviews of AD duty orders A-570-826 and A-570-827.

Summary: The DOC has announced that sunset reviews of the AD duty orders on cased pencils and paper clips from mainland China will be initiated in June. The reviews will result in either the revocation or continuation of the orders.

Summary: Each year during the anniversary month of the publication of an AD/CV duty order, finding or suspension of investigation, an interested party may request that the DOC conduct an administrative review of that particular action. The DOC is now giving interested parties the opportunity to request, by 31 May, administrative reviews of the AD duty orders on the following products from mainland China for the period 1 May 2015 through 30 April 2016: aluminium extrusions (A-570-967), circular welded carbon qualify steel line pipe (A-570-935), citric acid and citrate salt (A-570-937), iron construction castings (A-570-502), oil country tubular goods (A-570-943), pure magnesium (A-570-832) and stilbenic optical brightening agents (A-570-972). Parties may also request a review of the CV duty orders on aluminium extrusions (C-570-968) and citric acid and citrate salts (C-570-938) for the period 1 January through 31 December 2015. These reviews could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the reviews.

Product: Certain carbon and alloy steel cut-to-length plate, classified under HTSUS subheadings
Nature of Notice: Initiation of AD investigation A-570-047 and CV investigation A-570-048, effective 5 May.

Summary: The scope of these investigations includes certain carbon and alloy steel hot-rolled or forged flat plate products not in coils, whether or not painted, varnished or coated with plastics or other non-metallic substances. Subject merchandise includes plate that is produced by being cut-to-length from coils or from other discrete length plate and plate that is rolled or forged into a discrete length. Covered products include (i) universal mill plates (i.e., flat-rolled products rolled on four faces or in a closed box pass, of a width exceeding 150 mm but not exceeding 1,250 mm and of a thickness of not less than 4 mm, which are not in coils and without patterns in relief) and (ii) hot-rolled or forged flat steel products of a thickness of 4.75 mm or more and of a width which exceeds 150 mm and measures at least twice the thickness, and which are not in coils, whether or not with patterns in relief. These products may be rectangular, square, circular or other shapes and include products of either rectangular or non-rectangular cross-section where such non-rectangular cross-section is achieved subsequent to the rolling process (i.e., products that have been “worked after rolling”).

Steel products included in the scope of these investigations are products in which iron predominates by weight over each of the other contained elements and the carbon content is two percent or less by weight. Subject merchandise includes cut-to-length plate that has been further processed in the subject country or a third country, including but not limited to pickling, oiling, levelling, annealing, tempering, temper rolling, skin passing, painting, varnishing, trimming, cutting, punching, bevelling, slitting or any other processing that would not otherwise remove the merchandise from the scope of the investigations if performed in the country of manufacture of the cut-to-length plate. A range of products are excluded from the scope, as outlined in the applicable notices of investigation.

The USITC is scheduled to issue a preliminary injury determination in this investigation on 20 May.

Product: Polyethylene retail carrier bags, classified under HTSUS subheading 3923.21.0085.
Nature of Notice: Continuation of AD order A-570-886, effective 5 May 2016.

Summary: The USITC on 5 April determined that revocation of this AD duty order would likely lead to continuation or recurrence of material injury to an industry in the U.S. within a reasonably foreseeable time. Accordingly, the DOC has extended the order for an additional five years.

Product: Certain polyethylene terephthalate resin, classified under HTSUS subheading 3907.60.0030.
Nature of Notice: Issuance of AD duty order A-570-024, effective 6 May 2016.

Summary: The USITC issued on 31 March a final affirmative AD injury determination in its investigation of subject merchandise. Accordingly, the DOC has issued an AD duty order and has instructed CBP to collect AD cash deposits on imports of subject merchandise at the following rates.

Nature of Notice: Amended final affirmative determination and issuance of CV duty order C-570-025, effective 6 May 2016.

Summary: The final determination in this investigation was published on 14 March. Several parties filed ministerial error allegations on that same date and the DOC has now decided to make certain changes to the final subsidy rates. Specifically, the rate for the companies listed in the first row below has been amended from 6.83 percent to 7.53 percent, while the China-wide rate has been amended from 27.20 percent to 27.55 percent. The DOC will instruct CBP to collect CV cash deposits on imports of subject merchandise at these amended rates.

Summary: The DOC has rescinded its administrative review with respect to subject merchandise exported by 74 companies during the period 1 February 2015 through 31 January 2016 because the petitioners withdrew their requests for a review. As a result, the cash deposit rates for subject merchandise from these companies will continue to be the rates established in the most recently completed administrative review.

Product: Drawn stainless steel sinks, classified under HTSUS subheadings 7324.10.0000 and 7324.10.0010.
Nature of Notice: Preliminary results of administrative review and preliminary results of no shipments in AD investigation A-570-983, effective 12 May 2016.

Summary: The DOC has preliminarily established the following dumping margins for imports of subject merchandise during the period 1 April 2014 through 31 March 2015. If these results are finalised, CBP will assess AD duties on all appropriate entries using these rates, which will also be used to determine new AD cash deposit requirements.

Product: Large residential washers, classified under HTSUS subheading 8540.20.00.
Nature of Notice: Postponement of preliminary determination in AD investigation A-570-033, effective 12 May 2016.

Summary: The DOC has decided to postpone its preliminary determination in this investigation from 31 May to 19 July. The preliminary determination will indicate whether the DOC is likely to establish AD duties on imports of subject merchandise.

Product: Steel threaded rod, classified under HTSUS subheading 7318.15.5051, 7318.15.5056, 7318.15.5090 and 7318.15.2095.
Nature of Notice: Preliminary results and partial rescission of administrative review in AD investigation A-570-932, effective 13 May 2016.

Summary: The DOC has established the following dumping margins for imports of subject merchandise during the period 1 April 2014 through 31 March 2015. CBP will assess AD duties on all appropriate entries using these rates, which will also be used to determine new AD cash deposit requirements. CBP will not assess AD duties or impose cash deposit requirements on entries subject to a zero rate.
