AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Various products.
Nature of Notice: Initiation of administrative reviews of AD/CV duty orders, effective 1 August 2017.

Summary: The DOC has initiated separate administrative reviews of the following AD duty orders for the period 1 June through 31 May 2017: chlorinated isocyanurates (A-570-898), high pressure steel cylinders (A-570-977), polyester staple fibre (A-570-905) and tapered roller bearings (A-570-601). The DOC has also launched a review of the CV duty order on high pressure steel cylinders (C-570-978) for the period 1 January through 31 December 2016. These reviews are scheduled to be completed by 30 June 2018 and could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the applicable period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the review.

Nature of Notice: Opportunity to request administrative reviews of AD/CV duty orders, effective 1 August 2017.

Summary: Each year during the anniversary month of the publication of an AD/CV duty order, finding or suspension of investigation, an interested party may request that the DOC conduct an administrative review of that particular action. The DOC is now giving interested parties the opportunity to request, by 31 August, administrative reviews of the AD duty orders on the following products from mainland China for the period 1 August 2016 through 31 July 2017: floor-standing, metal-top ironing tables and parts thereof (A-570-888), laminated woven sacks (A-570-916), light-walled rectangular pipe and tube (A-570-914), passenger vehicle and light truck tyres (A-570-016), petroleum wax candles (A-570-504), polyethylene retail carrier bags (A-570-886), sodium nitrite (A-570-925), steel nails (A-570-909), sulfanilic acid (A-570-815), tetrahydrofurfuryl alcohol (A-570-887), and tow-behind lawn groomers and parts thereof (A-570-939). Parties may also request administrative reviews of the AD duty order on hydrofluorocarbon blends and components thereof (A-570-028) for the period 1 February 2016 through 31 July 2017, or the CV duty orders on the following products for the period 1 January through December 2016: laminated woven sacks (C-570-917), light-walled rectangular pipe and tube (C-570-915), passenger vehicle and light truck tyres (C-570-017) and sodium nitrite (C-570-926). These reviews could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the reviews.

Nature of Notice: Upcoming sunset reviews of AD duty orders -570-905 and A-570-864.

Summary: The DOC has announced that separate sunset reviews of the AD duty orders on polyester staple fibre and pure magnesium in granular form from mainland China will be initiated in September. The reviews will result in either the revocation or continuation of the orders.

Nature of Notice: Postponement of preliminary determination in AD investigation A-570-053, effective 1 August 2017.

Summary: The DOC has decided to postpone its preliminary determination in this investigation from 15 August to 4 October. The preliminary determination will indicate whether the DOC is likely to establish AD duties on imports of subject merchandise.

Product: Wooden bedroom furniture, classified under HTSUS subheadings 7009.92.1000, 7009.92.5000, 9403.20.0018, 9403.50.9041, 9403.50.9042, 9403.50.9045, 9403.50.9080 and 9403.60.8081.
Nature of Notice: Partial rescission of administrative review in AD investigation A-570-890, effective 2 August 2017.

Summary: The DOC has rescinded, based on the timely withdrawal of the review requests, its review of subject merchandise exported by 67 companies during the period 1 January through 31 December 2016. As a result, the cash deposit rates for subject merchandise from these companies will continue to be the rates established in the most recently completed administrative review.

Product: Certain stilbenic optical brightening agents, classified under HTSUS subheadings 2933.69.6050, 2921.59.4000, 2921.59.8090 and 3204.20.8000.
Nature of Notice: Final results of expedited sunset review in AD investigation A-570-972, effective 7 August 2017.

Summary: The DOC has determined that revocation of this AD duty order would likely lead to continuation or recurrence of dumping. The USITC will proceed with its own investigation to determine whether revocation would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. The order will be extended for an additional five years if the USITC issues an affirmative determination but will be rescinded if the USITC issues a negative determination.

Product: Fresh garlic, classified under HTSUS subheadings 0703.20.0000, 0703.20.0005, 0703.20.0015, 0703.20,0010, 0703.20.0020, 0703.20.0090, 0710.80.7060, 0710.80.9750, 0711.90.6000, 0711.90.6500, 2005.90.9500, 2005.90.9700 and 2005.99.9700.

Summary: The DOC has rescinded its administrative review of subject merchandise exported by Zhongshan Superte Kitchenware Co. Ltd. during the period 1 January through 31 December 2016 because that company withdrew its request for a review. As a result, the cash deposit rate for subject merchandise from this company will continue to be the rate established in the most recently completed administrative review.

Product: Monosodium glutamate, classified under HTSUS subheadings 2922.42.1000, 2922.42.5000, 2103.90.7200, 2103.90.7400, 2103.90.7800, 2103.90.8000 and 2103.90.9091.
Nature of Notice: Preliminary results of administrative review in AD investigation A-570-992, effective 7 August 2017.

Summary: The DOC has preliminarily determined that the 27 companies subject to this administrative review, which covers the period 1 November 2015 through 31 October 2016, are part of the China-wide entity. Since a review of the China-wide entity has not been requested, the DOC has preliminarily determined that these companies have not demonstrated their eligibility for separate rate status and are therefore subject to the China-wide rate of 40.41 percent.

Product: Xanthan gum, classified under HTSUS subheading 3913.90.20.
Nature of Notice: Preliminary results of administrative review and preliminary results of no shipments in AD investigation A-570-985, effective 7 August 2017.

Summary: The DOC has preliminarily established the following dumping margins for imports of subject merchandise during the period 1 July 2015 through 30 June 2016. If these results are finalised, CBP will assess AD duties on all appropriate entries using these rates, which will also be used to determine new AD cash deposit requirements. CBP will not assess AD duties or impose cash deposit requirements on applicable entries subject to a zero rate.

Product: Cast iron soil pipe fittings, classified under HTSUS subheading 7307.11.0045.
Nature of Notice: Initiation of AD investigation A-570-062 and CV investigation C-570-063, effective 2 August 2017.

Summary: The scope of these investigations covers cast iron soil pipe fittings, finished and unfinished, regardless of industry or proprietary specifications, and regardless of size. Cast iron soil pipe fittings are non-malleable iron castings of various designs and sizes, including bends, tees, wyes, traps, drains and other common or special fittings, with or without side inlets.

Cast iron soil pipe fittings are classified into two major types: hubless and hub and spigot. Hubless cast iron soil pipe fittings are manufactured without a hub, generally in compliance with Cast Iron Soil Pipe Institute specification 301 and/or American Society for Testing and Materials specification A888. Hub and spigot pipe fittings have hubs into which the spigot (plain end) of the pipe or fitting is inserted. Cast iron soil pipe fittings are generally distinguished from other types of non-malleable cast iron fittings by the manner in which they are connected to cast iron soil pipe and other fittings.

The USITC has scheduled its preliminary injury vote in connection with this investigation for 25 August.

Product: Fine denier polyester staple fibre, classified under HTSUS subheadings 5503.20.0045 and 5503.20.0065.
Nature of Notice: Postponement of preliminary determination in CV investigation C-570-061, effective 8 August 2017.

Summary: The DOC has decided to postpone its preliminary determination in this investigation from 24 August to 30 October. The preliminary determination will indicate whether the DOC is likely to establish CV duties on imports of subject merchandise.

Product: Seamless refined copper pipe and tube, classified under HTSUS subheadings  7411.10.1030, 7411.10.1090,7407.10.1500, 7419.99.5050, 8415.90.8065 and 8415.90.8085.
Nature of Notice: Preliminary results and partial rescission of administrative review in AD investigation A-570-964, effective 8 August 2017.

Summary: The DOC has preliminarily determined that the five remaining companies under review for the period 1 November 2015 through 31 October 2016 do not qualify for a separate rate and are therefore considered a part of the China-wide entity. The DOC has also rescinded its review with respect to 11 companies because the petitioners withdrew their review request.

Product: Furfuryl alcohol, classified under HTSUS subheading 2932.13.00.
Nature of Notice: Continuation of AD duty order A-570-835, effective 9 August 2017.

Summary: The USITC determined on 12 July that revocation of the AD duty order on subject merchandise would likely lead to continuation or recurrence of material injury to an industry in the U.S. within a reasonably foreseeable time. Accordingly, the DOC has extended the order for an additional five years.

Product: Steel wire garment hangers, classified under HTSUS subheadings 7326.20.0020 and 7323.99.9060.

Summary: The DOC has amended the final results of its administrative review of subject merchandise for the period 1 August 2013 through 31 July 2014 after the U.S. Court of International Trade sustained its final remand redetermination. As a result, the DOC has assigned an amended weighted-average dumping margin of 11.95 percent to SDC International Aust. PTY. Ltd.

Product: Glycine, classified under HTSUS subheading 2922.49.4020.
Nature of Notice: Preliminary results of changed circumstances review in AD investigation A-570-836, effective 11 August 2017.

Summary: The DOC has preliminarily determined that Salvi Chemical Industries Ltd. is eligible to participate in a certification process because it has demonstrated that its glycine is no longer processed from mainland Chinese-origin glycine. If the DOC upholds these preliminary results in the final results, it will notify CBP and allow Salvi’s importers of subject merchandise to certify that the glycine being produced and exported is not processed mainland Chinese-origin glycine.
