AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Rubber bands, classified under HTSUS subheadings 4016.99.3510 and 4016.99.6050.
Nature of Notice: Initiation of AD investigation A-570-069 and CV investigation C-570-070, effective 20 February 2018.

Summary: The scope of these investigations covers bands made of vulcanised rubber, with a flat length no less than half an inch and no greater than ten inches, with a width of at least 3/64 inch and no greater than two inches and a wall thickness from 0.020 inch to 0.125 inch. Vulcanised rubber has been chemically processed into a more durable material by the addition of sulphur or other equivalent curatives or accelerators. Subject merchandise is included regardless of colour or inclusion of printed material on the rubber band’s surface, including rubber bands with printing on them (such as a product name, advertising or slogan) and printed material (e.g., a tag) fastened to the rubber band by an adhesive or another temporary type of connection.

The scope includes vulcanised rubber bands that are contained or otherwise exist in various forms and packages, such as vulcanised rubber bands included within a desk accessory set or other type of set or package and vulcanised rubber band balls. The scope excludes products that consist of an elastomer loop and durable tag all-in-one, as well as bands that are being used at the time of import to fasten an imported product.

The USITC will issue its preliminary injury determination by 16 March (a vote has been scheduled for 15 March).

Product: Polytetrafluoroethylene resin, classified under HTSUS subheadings 3904.61.0010, 3904.61.0090 and 3904.69.5000.
Nature of Notice: Postponement of preliminary determination in AD investigation A-570-066.

Summary: The DOC has decided to postpone its preliminary determination in this investigation from 12 March to 30 April. The preliminary determination will indicate whether the DOC is likely to establish AD duties on imports of subject merchandise.

Summary: The DOC has determined that PT Sunhere Buana International failed to co-operate to the best of its ability in this review, which covers the period 1 February 2016 through 31 January 2017, and will therefore receive a dumping margin of 234.51 percent based on facts otherwise available with an adverse inference. For all previously investigated or reviewed exporters that received a separate rate in a prior segment of this proceeding, the cash deposit rate will continue to be the existing exporter-specific rate. For all exporters of subject merchandise that have not been found to be entitled to a separate rate, the cash deposit rate will be that for the China-wide entity (i.e., 234.51 percent).

Nature of Notice: Initiation of anti-circumvention inquiry in AD investigation A-570-967 and CV investigation C-570-968, effective 5 March 2018.

Summary: The DOC has initiated an anti-circumvention inquiry to determine whether extruded aluminium products that are exported from Vietnam by China Zhongwang Holdings Ltd. and its affiliates are circumventing the AD and CV duty orders on subject merchandise from the mainland. The DOC intends to consider whether these inquiries should apply to all exports of extruded aluminium products from Vietnam that meet the description of the orders. A final determination will normally be issued by 31 December.

Summary: Pursuant to the Enforce and Protect Act of 2015, the DOC has received a covered merchandise referral from CBP in connection with an investigation concerning the AD duty order on subject merchandise. Specifically, CBP has requested that the DOC issue a determination as to whether diamond sawblades, imported by Diamond Tools Technology LLC, that are laser welded in Thailand by Diamond Tools Technology (Thailand) Ltd. from (i) cores from Thailand and segments from mainland China, (ii) segments and cores that are both produced in mainland China, and/or (iii) cores from mainland China and segments from Thailand are covered by the AD duty order on subject merchandise from the mainland.

Summary: Pursuant to the Enforce and Protect Act of 2015, the DOC has received a covered merchandise referral from CBP in connection with an investigation concerning the AD duty order on subject merchandise. CBP has requested that the DOC issue a determination regarding certain merchandise imported by LM Supply Inc., specifically (i) whether the scope exclusion for Choice® R–421A is limited to only merchandise that is licenced by the rights holder or applies also to any HFC blends that satisfy the terms of the patents, and (ii) if the scope exclusion is limited to only that merchandise that also carries the trademarks indicated in the scope exclusion.

Summary: Each year during the anniversary month of the publication of an AD duty order, finding or suspension of investigation, an interested party may request that the DOC conduct an administrative review of that particular action. The DOC is now giving interested parties the opportunity to request, by 2 April, administrative reviews of the AD duty orders on the following products from mainland China: ammonium sulphate (A-570-049) – period of review 9 November 2016 through 28 February 2018; amorphous silica fabric (A-570-038) – POR 1 September 2016 through 28 February 2018; biaxial integral geogrid products (A-570-036) – POR 22 August 2016 through 28 February 2018; carbon and alloy steel cut-to-length plate (A-570-047) – POR 14 November 2016 through 28 February 2018; chloropicrin (A-570-002) – POR 1 March 2017 through 28 February 2018; circular welded austenitic stainless pressure pipe (A-570-930) – POR 1 March 2017 through 28 February 2018; glycine (A-570-836) – POR 1 March 2017 through 28 February 2018; sodium hexametaphosphate (A-570-908) – POR 1 March 2017 through 28 February 2018; certain tissue paper products (A-570-894) – POR 1 March 2017 through 28 February 2018; and uncoated paper (A-570-022) – POR 1 March 2017 through 28 February 2018.
