AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Polytetrafluoroethylene resin, classified under HTSUS subheadings 3904.61.0010, 3904.61.0090 and 3904.69.5000.
Nature of Notice: Preliminary affirmative determination, postponement of final determination and extension of provisional measures in AD investigation A-570-066, effective 7 May 2018.

Summary: The DOC has preliminarily established the following dumping margins for imports of subject merchandise. The DOC will instruct CBP to begin collecting AD cash deposits on imports of subject merchandise at these rates. If both the DOC and the USITC issue affirmative final determinations in this case, the DOC will issue an AD duty order and require AD cash deposits at the rates specified therein, which could be different from those set forth below.

Summary: The USITC determined on 29 March that revocation of the AD duty order on subject merchandise would likely lead to continuation or recurrence of material injury to an industry in the U.S. within a reasonably foreseeable time. Summary: The scope of these investigations covers certain quartz surface products consisting of slabs and other surfaces created from a mixture of materials that includes predominately silica (e.g., quartz, quartz powder, cristobalite) as well as a resin binder (e.g., an unsaturated polyester). The incorporation of other materials, such as pigments, cement or other additives, does not remove the merchandise from the scope. However, the scope only includes products where the silica content is greater than any other single material by actual weight.

Quartz surface products are typically sold as rectangular slabs with a total surface area of approximately 45 to 60 square feet and a nominal thickness of one, two or three centimetres. However, the scope includes surface products of all other sizes, thicknesses and shapes. In addition to slabs, the scope includes other surfaces such as countertops, backsplashes, vanity tops, bar tops, work tops, tabletops, flooring, wall facing, shower surrounds, fire place surrounds, mantels and tiles. Subject merchandise is covered whether polished or unpolished, cut or uncut, fabricated or not fabricated, cured or uncured, edged or not edged, finished or unfinished, thermoformed or not thermoformed, packaged or unpackaged, and regardless of the type of surface finish. In addition, quartz surface products are covered whether or not they are imported attached to, or in conjunction with, non-subject merchandise such as sinks, sink bowls, vanities, cabinets and furniture. If quartz surface products are imported attached to, or in conjunction with, such non-subject merchandise, only the quartz surface product is covered by the scope.

Subject merchandise includes material matching the above description that has been finished, packaged or otherwise fabricated in a third country, including by cutting, polishing, curing, edging, thermoforming, attaching to, or packaging with another product, or any other finishing, packaging or fabrication that would not otherwise remove the merchandise from the scope of the investigations if performed in the country of manufacture of the quartz surface products. The scope does not cover quarried stone surface products such as granite, marble, soapstone or quartzite. Also excluded are crushed glass surface products, that is, surface products in which the crushed glass content is greater than any other single material by actual weight.

The USITC will issue its preliminary injury determination by 1 June (a vote has been scheduled for 31 May).

Summary: The DOC has preliminarily established the following dumping margin for imports of subject merchandise during the period 1 April 2016 through 31 March 2017. CBP will assess AD duties on all appropriate entries using this rate, which will also be used to determine new AD cash deposit requirements.

The DOC also determined that RMB Fasteners Ltd. and IFI & Morgan Ltd. had no reviewable transactions during the period of review. In addition, the DOC has rescinded its review with respect to all companies except Jiaxing Brother Standard Part Co. Ltd., RMB/IFI, Brother Holding Group Co. Ltd., Zhejiang Morgan Brother Technology Co. Ltd. and Fastenal Canada after the petitioner timely withdrew its review request.

Summary: The DOC has preliminarily rescinded its new shipper review of Qingdao Doo Won Foods Co. Ltd. for the period 1 November 2016 through 30 April 2017 following a determination that that company is not the producer of the fresh garlic it exported to the United States.

Summary: In its administrative review of subject merchandise for the period 1 April 2016 through 31 March 2017, the DOC has determined that Tianjin Magnesium International Co. Ltd. and Tianjin Magnesium Metal Co. Ltd. did not have any reviewable entries during that time. Accordingly, any suspended entries of subject merchandise during the POR from these companies will be liquidated at the China-wide rate of 141.49 percent.

Product: Utility scale wind towers, classified under HTSUS subheadings 7308.20.0020 and 8502.31.0000.

Summary: The DOC has determined that revocation of this CV duty order would likely lead to continuation or recurrence of a countervailable subsidy. The USITC will proceed with its own investigation to determine whether revocation would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. The order will be extended for an additional five years if the USITC issues an affirmative determination but will be rescinded if the USITC issues a negative determination.
