AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Certain cased pencils, classified under HTSUS subheading 9609.10.00.
Nature of Notice: Rescission of administrative review in AD investigation A-570-827, effective 18 June 2018.

Summary: The DOC has rescinded based on the timely withdrawal of the review request its administrative review of the AD duty order on subject merchandise exported by Shandong Rongxin Import & Export Co. Ltd., Wah Yuen Stationery Co. Ltd. and any affiliated entities, including Shandong Wah Yuen Stationery Co. Ltd. and Tianjin Tonghe Stationery Co. Ltd., during the period 1 December 2016 through 30 November 2017. As a result, the cash deposit rates for subject merchandise from these companies will continue to be the rates established in the most recently completed administrative review.

Summary: The scope of these investigations covers steel cylinders for compressed or liquefied propane gas meeting the requirements of, or produced to meet the requirements of, U.S. Department of Transportation Specifications 4B, 4BA or 4BW, or Transport Canada Specification 4BM, 4BAM or 4BWM, or United Nations pressure receptacle standard ISO 4706. The scope includes steel propane cylinders regardless of whether they have been certified to these specifications before importation.

Steel propane cylinders range from 2.5 pound nominal gas capacity (approximate six pound water capacity and approximate four to six pound tare weight) to 42 pound nominal gas capacity (approximate 100 pound water capacity and approximate 28 to 32 pound tare weight). Subject cylinders have two or fewer ports and may be imported assembled or unassembled (i.e., welded or brazed before or after importation), with or without all components (including collars, valves, gauges, tanks, foot rings, and overfill prevention devices), and coated or uncoated. Also included within the scope are drawn cylinder halves, unfinished propane cylinders, collars and foot rings for steel propane cylinders. An ‘‘unfinished’’ or ‘‘unassembled’’ propane cylinder includes drawn cylinder halves that have not been welded into a cylinder, cylinders that have not had flanges welded into the port hole(s), cylinders that are otherwise complete but have not had collars or foot rings welded to them, otherwise complete cylinders without a valve assembly attached, and cylinders that are otherwise complete except for testing, certification and/or marking.

The proceedings also cover subject cylinders that meet, are produced to meet, or are certified as meeting other U.S. or Canadian government, international or industry standards (including, for example, American Society of Mechanical Engineers or American National Standard Institute), if they also meet, are produced to meet, or are certified as meeting USDOT Specification 4B, 4BA or 4BW, or Transport Canada Specification 4BM, 4BAM or 4BWM, or UN pressure receptacle standard ISO 4706. Also covered are steel propane cylinders that have been further processed in a third country, including attachment of collars, foot rings or handles by welding or brazing, heat treatment, painting, testing, certification or any other processing that would not otherwise remove the merchandise from the scope of the investigations if performed in the country of manufacture of the in-scope steel propane cylinders.

Specifically excluded are seamless steel propane cylinders and propane cylinders made from stainless steel (i.e., steel containing at least 10.5 percent chromium by weight and less than 1.2 percent carbon by weight), aluminium or composite fibre material. Composite fibre material is material consisting of the mechanical combination of two components: fibre (typically glass, carbon or aramid (synthetic polymer)) and a matrix material (typically polymer resin, ceramic or metallic).

The USITC will issue its preliminary injury determination by 6 July (a vote has been scheduled for 5 July).

Product: Pure magnesium, classified under HTSUS subheadings 3824.90.11, 3824.90.19, 8104.11.00, 8104.19.00, 8104.20.00, 8104.30.00, 8104.90.00 and 9817.00.90.
Nature of Notice: Final results of administrative review in AD investigation A-570-832, effective 19 June 2018.

Summary: In its administrative review of the AD duty order on subject merchandise for the period 1 May 2016 through 30 April 2017, the DOC has determined that Tianjin Magnesium International Co. Ltd. and Tianjin Magnesium Metal Co. Ltd. had no shipments of subject merchandise during the period of review. Accordingly, the cash deposit rate for subject merchandise from these companies will continue to be the rate established in the most recently completed administrative review.

Summary: The DOC has preliminarily established the following subsidy rates for imports of subject merchandise. The DOC will instruct CBP to begin collecting CV cash deposits on imports of subject merchandise at these rates. If both the DOC and the USITC issue affirmative final determinations in this case, the DOC will issue a CV duty order and require CV cash deposits at the rates specified therein, which could be different from those set forth below.

The DOC has also preliminarily determined that critical circumstances exist for Nanjie Resources Co. Limited, Yong Jie New Material Co. Ltd., Zhejiang Yongjie Aluminum Co. Ltd., Zhejiang GKO Aluminium Stock Co. Ltd., the companies eligible for a separate rate and the China-wide entity, but do not exist for Henan Mingtai Al Industrial Co. Ltd. and Zhengzhou Mingtai Industry Co. Ltd. Finally, the DOC has decided to postpone its final determination in this investigation until 5 November and extend the provisional measures from a four-month to a six-month period.

Product: Cast iron soil pipe, classified under HTSUS subheading 7303.00.0030.
Nature of Notice: Postponement of preliminary determination in AD investigation A-570-079.
