Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Cast iron pipe fittings, classified under HTSUS subheadings 7307.11.0045, 7324.29.0000 and 7307.92.3010.
Nature of Notice: Final affirmative determination in CV investigation C-570-063, effective 11 July 2018.

Summary: The DOC has established the following subsidy rates for imports of subject merchandise. If the USITC issues a final affirmative injury determination in this case, the DOC will issue a CV duty order and instruct CBP to collect CV cash deposits on imports of subject merchandise at the following rates.

Nature of Notice: Continuation of AD duty order A-570-866, effective 11 July 2018.

Summary: The USITC determined on 20 June that revocation of the AD duty order on subject merchandise would likely lead to continuation or recurrence of material injury to an industry in the U.S. within a reasonably foreseeable time. Accordingly, the DOC has extended the order for an additional five years.

Summary: The final results of this review, which covers the period 1 January through 31 December 2015, were published on 13 April. One party subsequently filed ministerial error allegations and the DOC has now decided to make certain changes to the final subsidy rates, as follows. The DOC will instruct CBP to collect CV cash deposits on imports of subject merchandise at these amended rates.

Summary: The DOC has preliminarily established the following dumping margins for imports of subject merchandise during the period 1 June 2016 through 31 May 2017. CBP will assess AD duties on all appropriate entries using these rates, which will also be used to determine new AD cash deposit requirements.

The DOC has also determined that 12 companies involved in the administrative review did not demonstrate that they are entitled to a separate rate and has therefore preliminarily assigned the China-wide rate of 92.84 percent to those companies. One additional company, Hangzhou Xiaoshan Dingli Machinery Co. Ltd., could not demonstrate that it had a suspended entry during the period of review so the DOC intends to rescind its review with respect to that company.

Nature of Notice: Initiation of administrative reviews of AD/CV duty orders, effective 12 July 2018.

Summary: The DOC has initiated separate administrative reviews of the AD duty orders on aluminium extrusions (A-570-967), oil country tubular goods (A-570-943), pure magnesium (A-570-832), and circular welded carbon steel pipes and tubes (A-570-501) for the period 1 May 2017 through 30 April 2018, the AD duty order on 1-hydroxyethylidene-1,1-diphoshonic acid (HEDP) (A-570-045) for the period 14 November 2016 through 30 April 2018, the CV duty order on 1-hydroxyethylidene-1,1-diphoshonic acid (HEDP) (C-570-046) for the period 8 September 2016 through 31 December 2017, and the CV duty order on aluminium extrusions (C-570-968) for the period 1 January through 31 December 2017. These reviews are scheduled to be completed by 31 May 2019 and could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the applicable period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the review.

Product: Certain steel nails, classified under HTSUS subheadings 7317.00.55, 7317.00.65, 7317.00.75 and 7907.00.6000.
Nature of Notice: Court decision not in harmony with final results of administrative review in AD investigation A-570-909, effective 19 June 2018.

Summary: The DOC has amended the final results of its administrative review of subject merchandise for the period 1 August 2012 through 31 July 2013 after the U.S. Court of International Trade sustained its final remand redetermination. As a result, the dumping margin for The Stanley Works (Langfang) Fastening Systems Co. Ltd. has been amended to 10.16 percent but the margin for Xi’an Metals & Minerals Import & Export Co. Ltd. will remain unchanged. In the event that the court’s ruling is not appealed or, if appealed, is upheld by a final and conclusive court decision, the DOC will instruct CBP to assess AD duties on unliquidated entries of subject merchandise based on the revised rate.

Summary: The scope of these investigations covers steel racks and parts thereof, assembled to any extent or unassembled, including vertical components (e.g., uprights, posts or columns), horizontal or diagonal components (e.g., arms or beams), braces, frames, locking devices (i.e., end plates and beam connectors) and accessories (including rails, skid channels, skid rails, drum/coil beds, fork clearance bars, pallet supports, column and post protectors, end row and end aisle protectors, corner guards, row spacers and wall ties).

Subject steel racks and parts thereof are made of steel, including cold and/or hot-formed steel, regardless of the type of steel used to produce the components, and may or may not include locking tabs, slots or bolted, clamped or welded connections. Steel rack components can be assembled into structures of various dimensions and configurations by welding, bolting, clipping or with the use of devices such as clips, end plates and beam connectors, including to the following configurations: (1) racks with upright frames perpendicular to the aisles that are independently adjustable, with positive locking beams parallel to the aisle spanning the upright frames with braces, and (2) cantilever racks with vertical components parallel to the aisle and cantilever beams or arms connected to the vertical components perpendicular to the aisle.

Steel racks may be referred to as pallet racks, storage racks, stacker racks, retail racks, pick modules, selective racks or cantilever racks and may incorporate moving components and be referred to as pallet-flow racks, carton-flow racks, pushback racks, movable-shelf racks, drive-in racks and drive-through racks. While steel racks may be made to ANSI MH16.l or ANSI MH16.3 standards, all steel racks and parts thereof meeting the description set out herein are covered by the scope of these investigations, whether or not produced according to a particular standard.

The scope includes all steel racks and parts thereof meeting the description above, regardless of (1) dimensions, weight, strength, gauge or load rating; (2) vertical components or frame type (including structural, roll-form or other); (3) horizontal support or beam/brace type (including structural, roll-form, slotted, unslotted, Z-beam, C-beam, L-beam, step beam and cantilever beam); (4) number of supports; (5) number of levels; (6) surface coating, if any (including paint, epoxy, powder coating, zinc or other metallic coatings); (7) shape (including rectangular, square, corner and cantilever); (8) the method by which the vertical and horizontal supports connect (including locking tabs or slots, bolting, clamping and welding); and (9) whether or not the steel rack has moving components (including rails, wheels, rollers, tracks, channels, carts and conveyors).

Subject merchandise includes merchandise matching the above description that has been finished or packaged in a third country. Finishing includes coating, painting or assembly, including attaching the merchandise to another product, or any other finishing or assembly operation that would not remove the merchandise from the scope of the investigations if performed in the country of manufacture of the steel racks and parts thereof. Packaging includes packaging the merchandise with or without another product or any other packaging operation that would not remove the merchandise from the scope of the investigations if performed in the country of manufacture of the steel racks and parts thereof. Steel racks and parts thereof are included in the scope whether or not imported attached to, or included with, other parts or accessories such as wire decking, nuts and bolts. If steel racks and parts thereof are imported attached to, or included with, such non-subject merchandise, only the steel racks and parts thereof are included in the scope.

The scope does not cover (1) decks (i.e., shelving that sits on or fits into the horizontal supports to provide the horizontal storage surface of the steel racks); (2) wire shelving units (i.e., shelves made from wire that incorporate both a wire deck and wire horizontal supports, taking the place of the horizontal beams and braces, into a single piece with tubular collars that slide over the posts and onto plastic sleeves snapped on the posts to create a finished unit; (3) pins, nuts, bolts, washers and clips used as connecting devices; and (4) non-steel components. Also excluded from the scope are any products covered by the DOC’s existing AD and CV duty orders on boltless steel shelving units pre-packaged for sale, as well as bulk-packed parts or components of boltless steel shelving units that were specifically excluded from the scope of these orders because such bulk-packed parts or components do not contain the steel vertical supports (i.e., uprights and posts) and steel horizontal supports (i.e., beams, braces) packaged together for assembly into a completed boltless steel shelving unit.

The USITC will issue its preliminary injury determination by 6 August (a vote has been scheduled for 3 August).
