AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Certain steel wheels 12 to 16.5 inches in diameter, classified under HTSUS subheadings 7326.90.8688, 9403.20.0080, 9403.90.8041, 7308.90.3000, 7308.90.6000, 7308.90.9590 and 9403.20.0090.
Nature of Notice: Postponement of preliminary determination in CV investigation C-570-091.

Summary: The DOC has decided to postpone its preliminary determination in this investigation from 1 November 2018 to 7 January 2019. The preliminary determination will indicate whether the DOC is likely to establish CV duties on imports of subject merchandise.

Product: Steel propane cylinders, classified under HTSUS subheadings 7311.00.0060 and 7311.00.0090.
Nature of Notice: Postponement of preliminary determination in AD investigation A-570-086.

Summary: The DOC has decided to postpone its preliminary determination in this investigation from 29 October to 18 December. The preliminary determination will indicate whether the DOC is likely to establish AD duties on imports of subject merchandise.

Product: Freshwater crawfish tail meat, classified under HTSUS subheadings 0306.19.0010, 0306.29.0000, 1605.40.1010 and 1605.40.1090.
Nature of Notice: Preliminary results of administrative and new shipper reviews and partial rescission of administrative review in AD investigation A-570-848, effective 16 October 2016.

Summary: The DOC has preliminarily established the following dumping margins for imports of subject merchandise during the period 1 September 2016 through 31 August 2017. If these results are finalised, CBP will not assess AD duties or require cash deposits on appropriate entries.

The DOC has also rescinded its administrative review of Deyan Aquatic Products and Food Co. Ltd., Hubei Yuesheng Aquatic Products Co. Ltd., Jingzhou Tianhe Aquatic Products Co. Ltd. and Shanghai Ocean Flavor International Trading Co. Ltd. based on the timely withdrawal of the review request.

Product: Refillable stainless steel kegs, classified under HTSUS subheadings 7310.10.0010, 7310.00.0050, 7310.29.0025 and 7310.29.0050.
Nature of Notice: Initiation of AD investigation A-570-093 and CV investigation C-570-094, effective 10 October 2018.

Summary: The scope of these investigations covers kegs, vessels or containers that are approximately cylindrical in shape, made from stainless steel (i.e., steel containing at least 10.5 percent chromium by weight and less than 1.2 percent carbon by weight, with or without other elements), compatible with a “D Sankey” extractor (commonly known as a “D Coupler” or “Sankey”), with a nominal liquid volume capacity of 10 litres or more, regardless of the type of finish, gauge, thickness or grade of stainless steel, and whether or not covered by or encased in other materials. Subject merchandise may be imported assembled or unassembled, with or without all components (including spears, couplers or taps, necks, collars and valves), and be filled or unfilled.

“Unassembled” or “unfinished” refillable stainless steel kegs include drawn stainless steel cylinders that have been welded to form the body of the keg and welded to an upper (top) chime and/or lower (bottom) chime. Unassembled refillable stainless steel kegs may or may not be welded to a neck, may or may not have a valve assembly attached, and may be otherwise complete except for testing, certification and/or marking. Subject merchandise also includes refillable stainless steel kegs that have been further processed in a third country, including attachment of necks, collars, spears or valves, heat treatment, pickling, passivation, painting, testing, certification or any other processing that would not otherwise remove the merchandise from the scope of the investigations if performed in the country of manufacture of the in-scope refillable stainless steel keg.

Specifically excluded are the following: (1) vessels or containers that are not approximately cylindrical in nature (e.g., box, “hopper” or “cone” shaped vessels); (2) stainless steel kegs, vessels or containers that have either a “ball lock” valve system or a “pin lock” valve system (commonly known as “Cornelius,” “corny” or “ball lock” kegs); (3) necks, spears, couplers or taps, collars and valves that are not imported with the subject merchandise; and (4) stainless steel kegs that are filled with beer, wine or other liquid and that are designated by the commissioner of Customs as instruments of international traffic within the meaning of section 332(a) of the Tariff Act of 1930, as amended.

The USITC will issue its preliminary injury determination by 5 November (a vote has been scheduled for 2 November).

Product: Xanthan gum, classified under HTSUS subheading 3913.90.2015.
Nature of Notice: Court decision not in harmony with final determination in AD investigation A-570-985, effective 27 September 2018.

Summary: Pursuant to a final judgment by the U.S. Court of International Trade, the DOC has amended its final determination in the AD investigation of subject merchandise by excluding the following companies from the order: Neimenggu Fufeng Biotechnologies Co. Ltd. (also known as Inner Mongolia Fufeng Biotechnologies Co. Ltd.) and Shandong Fufeng Fermentation Co. Ltd.

Product: Aluminium wire and cable, classified under HTSUS subheadings 8544.49.9000 and 8544.42.9090.
Nature of Notice: Initiation of AD investigation A-570-095 and CV investigation C-570-096, effective 12 October 2018.

Summary: The scope of these investigations covers aluminium wire and cable, which is defined as an assembly of one or more electrical conductors made from 8000 Series Aluminum Alloys (defined in accordance with ASTM B800), Aluminum Alloy 1350 (defined in accordance with ASTM B230/B230M or B609/B609M) and/or Aluminum Alloy 6201 (defined in accordance with ASTM B398/B398M), provided that (i) at least one of the electrical conductors is insulated; (ii) each insulated electrical conductor has a voltage rating greater than 80 volts and not exceeding 1,000 volts; and (iii) at least one electrical conductor is stranded and has a size not less than 16.5 thousand circular mil (kcmil) and not greater than 1,000 kcmil. The assembly may (i) include a grounding or neutral conductor; (ii) be clad with aluminium, steel or other base metal; or (iii) include a steel support centre wire, one or more connectors, a tape shield, a jacket or other covering, and/or filler materials.

Most aluminium wire and cable products conform to National Electrical Code types THHN, THWN, THWN-2, XHHW-2, USE, USE-2, RHH, RHW or RHW-2, and also conform to Underwriters Laboratories standards UL-44, UL-83, UL-758, UL-854, UL-1063, UL-1277, UL1569, UL-1581 or UL-4703. However, such conformity is not required for the merchandise to be included within the scope. The scope of the investigations specifically excludes conductors that are included in equipment already assembled at the time of importation. Also excluded are aluminium wire and cable products in actual lengths less than six feet.

The USITC will issue its preliminary injury determination by 5 November (a vote has been scheduled for 2 November).
