AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Certain quartz surface products, classified under HTSUS subheadings 6810.99.0010, 6810.11.0010, 6810.11.0070, 6810.19.1200, 6810.19.1400, 6810.19.5000, 6810.91.0000, 6810.99.0080, 6815.99.4070, 2506.10.0010, 2506.10.0050, 2506.20.0010 and 2506.20.0080.
Nature of Notice: Partial preliminary affirmative determination of critical circumstances in CV investigation C-570-085, effective 15 November 2018.

Summary: The DOC has preliminarily determined that critical circumstances exist with regard to Fasa Industrial Corporation Limited and Foshan Hero Stone Co. Ltd. but do not exist for all other exporters or producers. The DOC will instruct CBP to suspend liquidation of any unliquidated entries of subject merchandise from Fasa Industrial and Hero Stone that were entered, or withdrawn from warehouse for consumption, on or after 23 June, which is 90 days prior to the date of publication of the preliminary determination. For such entries, CBP will require a cash deposit equal to the estimated preliminary subsidy rates established in the preliminary determination.

Product: Certain steel threaded rod, classified under HTSUS subheading 7318.15.5051, 7318.15.5056, 7318.15.5090 and 7318.15.2095.
Nature of Notice: Final results of administrative review and final determination of no shipments in AD investigation A-570-932, effective 15 November 2018.

Summary: The DOC has established the following dumping margin for imports of subject merchandise during the period 1 April 2016 through 31 March 2017. CBP will assess AD duties on all appropriate entries using this rate, which will also be used to determine new AD cash deposit requirements.

The DOC has also determined that RMB/IFI, a single entity that includes Jiaxing Brother Standard Part Co. Ltd. and Jiaxing Brother Fastener Co. Ltd., had no reviewable transactions during the period of review.

Product: Diamond sawblades and parts thereof, classified under HTSUS subheadings 6804.21.0000,  8202.39.0000 and 8206.00.0000.
Nature of Notice: Preliminary affirmative determination of circumvention in AD investigation A-570-900, effective 15 November 2018.

Summary: The DOC has preliminarily determined that diamond sawblades produced by Diamond Tools Technology (Thailand) Co. Ltd. in Thailand using cores and/or segments from mainland China and exported from Thailand to the United States are circumventing the AD duty order on subject merchandise from the mainland. The DOC will direct CBP to suspend liquidation and require a cash deposit of estimated duties on unliquidated entries of subject merchandise produced (i.e., assembled or completed) using mainland Chinese cores and/or mainland Chinese segments by Diamond Tools in Thailand that were entered, or withdrawn from warehouse, for consumption on or after 1 December 2017, the date of initiation of this anti-circumvention inquiry.

Nature of Notice: Initiation of administrative reviews of AD/CV duty orders, effective 15 November 2018.

Summary: The DOC has initiated separate administrative reviews of the following AD duty orders: certain magnesia carbon bricks (A-570-954) – period of review 1 September 2017 through 31 August 2018; certain new pneumatic off-the-road tyres (A-570-912) – POR 1 September 2017 through 31 August 2018; certain steel nails (A-570-909) – period of review 1 August 2017 through 31 July 2018; freshwater crawfish tail meat (A=570-848) – period of review 1 September 2017 through 31 August 2018; and hydrofluorocarbon blends (A-570-028) – period of review 1 August 2017 through 31 July 2018. The DOC has also launched reviews of the CV duty orders on certain magnesia carbon bricks (C-570-955), certain new pneumatic off-the-road tyres (C-570-913), certain passenger vehicle and light truck tyres (C-570-017) and narrow woven ribbons with woven selvedge (C-570-953) for the period 1 January through 31 December 2017. These reviews are scheduled to be completed by 30 September 2019 and could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the applicable period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the review.

Product: Tapered roller bearings and parts thereof, classified under HTSUS subheadings 8482.20.00, 8482.91.0050, 8482.99.15, 8482.99.45, 8483.20.40, 8483.20.80, 8483.30.80, 8483.90.20, 8483.90.30, 8483.90.80, 8708.99.8015 and 8708.99.8080.
Nature of Notice: Partial rescission of administrative review in AD investigation A-570-601, effective 19 November 2018.

Summary: The DOC has rescinded based on the timely withdrawal of the review requests its administrative review of subject merchandise exported by ten companies during the period 1 June 2017 through 31 May 2018. As a result, the cash deposit rates for subject merchandise from these companies will continue to be the rates established in the most recently completed administrative review.

Nature of Notice: Amended final results of administrative review in AD investigation A-570-904, effective 19 November 2018.

Summary: The DOC has amended the final results of its administrative review of subject merchandise for the period 1 April 2016 through 31 March 2017 to correct certain ministerial errors. CBP will assess AD duties on all appropriate entries using the amended rates shown below, which will also be used to determine new AD cash deposit requirements. CBP will not assess AD duties or require cash deposits on entries subject to a zero rate.

Nature of Notice: Court decision not in harmony with final results of administrative review in AD investigation A-570-898, effective 3 November 2018.

Summary: The DOC has amended the final results of its administrative review of subject merchandise for the period 1 June 2012 through 31 May 2013 after the U.S. Court of International Trade sustained its final remand redetermination. As a result, Heze Huayi Chemical Co. Ltd.’s rate has been amended from 53.15 percent to zero percent. In the event the CIT’s ruling is not appealed, or, if appealed, is upheld by a final and conclusive court decision, the DOC will instruct CBP to liquidate Heze Huayi’s appropriate entries without regard to AD duties.

Product: Rubber bands, classified under HTSUS subheadings 4016.99.3510 and 4016.99.6050.
Nature of Notice: Final affirmative determination in CV investigation C-570-070, effective 20 November 2018.

Summary: The DOC has established the following subsidy rates for imports of subject merchandise. If the USITC issues a final affirmative injury determination in this case, the DOC will issue a CV duty order and instruct CBP to collect CV cash deposits on imports of subject merchandise at the following rates.

Summary: The DOC has preliminarily established the following dumping margins for imports of subject merchandise. The DOC will instruct CBP to begin collecting AD cash deposits on imports of subject merchandise at these rates. If both the DOC and the USITC issue affirmative final determinations in this case, the DOC will issue an AD duty order and require AD cash deposits at the rates specified therein, which could be different from those set forth below.

The DOC has also postponed its deadline for a final determination in this investigation until 4 April 2019 and extended the provisional measures from a four-month period to a period no greater than six months.
