AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Xanthan gum, classified under HTSUS subheading 3913.90.2015.
Nature of Notice: Continuation of AD duty order A-570-985, effective 30 November 2018.

Summary: The USITC determined on 23 October that revocation of the AD duty order on subject merchandise would likely lead to continuation or recurrence of material injury to an industry in the U.S. within a reasonably foreseeable time. Accordingly, the DOC has extended the order for an additional five years.

Nature of Notice: Upcoming sunset reviews of AD duty orders A-570-865, A-570-912, A-570-975, A-570-922 and A-570-925 and CV duty orders C-570-913 and C-570-923.

Summary: The DOC has announced that separate sunset reviews of the AD and CV duty orders on new pneumatic off-the-road tyres and raw flexible magnets as well as the AD duty orders on certain hot-rolled carbon steel flat products, non-malleable cast iron pipe fittings and sodium nitrite from mainland China will be initiated in January. The reviews will result in either the revocation or continuation of the orders.

Nature of Notice: Initiation of sunset reviews of AD duty order A-570-909, effective 1 December 2018.

Summary: The DOC has initiated a sunset review of the AD duty order on subject merchandise from mainland China. The review will result in either the revocation or continuation of the order.

Nature of Notice: Opportunity to request administrative reviews of AD/CV duty orders, effective 3 December 2018.

Summary: Each year during the anniversary month of the publication of an AD/CV duty order, finding or suspension of investigation, an interested party may request that the DOC conduct an administrative review of that particular action. The DOC is now giving interested parties the opportunity to request, by 31 December, administrative reviews of the AD duty orders on the following products from mainland China for the period 1 December 2017 through 31 November 2018: carbazole violet pigment 23 (A-570-892), cased pencils (A-570-827), crystalline silicon photovoltaic cells, whether or now assembled into modules (A-570-979), hand trucks and certain parts thereof (A-570-891), honey (A-570-863), malleable cast iron pipe fittings (A-570-881), melamine (A-570-020), multi-layered wood flooring (A-570-970), non-oriented electrical steel (A-570-996), porcelain-on-steel cooking ware (A-570-506) and silicomanganese (A-570-828). Parties may also request a review of the CV duty orders on crystalline silicon photovoltaic cells, whether or now assembled into modules (C-570-980), melamine (C-570-021), non-oriented electrical steel (C-570-997) and multi-layered wood flooring (C-570-971) for the period 1 January through 31 December 2017. These reviews could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the reviews.

Product: Refillable stainless steel kegs, classified under HTSUS subheadings 7310.10.0010, 7310.00.0050, 7310.29.0025 and 7310.29.0050.
Nature of Notice: Postponement of preliminary determination in CV investigation C-570-094.

Summary: The DOC has decided to postpone its preliminary determination in this investigation from 14 December 2018 to 19 February 2019. The preliminary determination will indicate whether the DOC is likely to establish CV duties on imports of subject merchandise.
