AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Pure magnesium, classified under HTSUS subheadings 3824.90.11, 3824.90.19, 8104.11.00, 8104.19.00, 8104.20.00, 8104.30.00, 8104.90.00 and 9817.00.90.

Nature of Notice: Preliminary results of administrative review in AD investigation A-570-832, effective 13 March 2019.

Summary: In its administrative review of the AD duty order on subject merchandise for the period 1 May 2017 through 30 April 2018, the DOC has determined that Tianjin Magnesium International Co. Ltd. and Tianjin Magnesium Metal Co. Ltd. had no shipments of subject merchandise during the period of review. If these results are finalised, the cash deposit rate for subject merchandise from these companies will continue to be the rate established in the most recently completed administrative review.

Nature of Notice: Initiation of administrative reviews of AD duty orders, effective 14 March 2019.

Summary: The DOC has initiated separate administrative reviews of the following AD duty orders for the period 1 December 2017 through 30 November 2018: certain cased pencils (A-570-827); crystalline silicon photovoltaic products, whether or not assembled into modules (A-570-979); honey (A-570-863); malleable cast iron pipe fittings (A-570-881); and multi-layered wood flooring (A-570-970). The DOC has also launched reviews of the AD duty order on fresh garlic (A-570-831) for the period 1 November 2017 through 31 October 2018 as well as the CV duty orders on multi-layered wood flooring (C-570-971) and crystalline silicon photovoltaic products, whether or not assembled into modules (C-570-980) for the period 1 January through 31 December 2017. These reviews are scheduled to be completed by 31 December 2019 and could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the applicable period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the review.

Nature of Notice: Notice of scope rulings.

Summary: The DOC has published the following list of scope rulings completed between 1 July and 30 September 2017. Scope rulings serve to determine whether a particular product is within the scope of an AD and/or CV duty order. Scope issues typically arise in cases where the descriptions of subject merchandise contained in the DOC’s determinations are ambiguous. It is also possible that, as technology evolves and new products are created, these new products may fall outside the scope of the order.

Summary: The DOC has preliminarily established the following subsidy rates for imports of subject merchandise during the period 1 January through 31 December 2017. If these results are finalised, CBP will assess CV duties on all appropriate entries using these rates, which will also be used to determine new CV cash deposit requirements.

Summary: The DOC has preliminarily determined that none the companies subject to this review, which covers the period 1 May 2017 through 30 April 2018, have established their entitlement to a separate rate. If these results are finalised, all mainland Chinese exporters of subject merchandise that have not been found to be entitled to a separate rate will face a China-wide rate of 99.14 percent.

Product: Carbon and alloy steel threaded rod, classified under HTSUS subheadings 7318.15.5051, 7318.15.5056, 7318.15.5090, 7318.15.2095 and 7318.19.0000.

Nature of Notice: Initiation of AD investigation A-570-104 and CV investigation C-570-105, effective 13 March 2019.

Summary: The scope of these investigations covers certain threaded rod, bar or studs of carbon or alloy steel, having a solid, circular cross section of any diameter, in any straight length. Steel threaded rod is normally drawn, cold-rolled, threaded and straightened, or it may be hot-rolled. In addition, the steel threaded rod, bar or studs subject to these investigations are non-headed and threaded along greater than 25 percent of their total actual length. A variety of finishes or coatings, such as plain oil finish as a temporary rust protectant, zinc coating (i.e., galvanised, whether by electroplating or hot-dipping), paint and other similar finishes and coatings, may be applied to the merchandise.

Steel threaded rod is normally produced to American Society for Testing and Materials specifications ASTM A36, ASTM A193 B7/B7m, ASTM A193 B16, ASTM A307, ASTM A329 L7/L7M, ASTM A320 L43, ASTM A354 BC and BD, ASTM A449, ASTM F1554-36, ASTM F1554-55 and ASTM F1554 Grade 105, American Society of Mechanical Engineers specification ASME B18.31.3 and American Petroleum Institute specification API 20E. All steel threaded rod meeting the physical description set forth above is covered by the scope of these investigations, whether or not produced according to a particular standard.

Subject merchandise includes material matching the above description that has been finished, assembled or packaged in a third country, including by cutting, chamfering, coating or painting the threaded rod, by attaching the threaded rod to, or packaging it with, another product, or any other finishing, assembly or packaging operation that would not otherwise remove the merchandise from the scope of the investigations if performed in the country of manufacture of the threaded rod. Carbon and alloy steel threaded rod also falls within the scope whether or not imported attached to, or in conjunction with, other parts and accessories such as nuts and washers (in such instances, only the threaded rod would be covered).

Excluded from the scope are (1) threaded rod, bar or studs that are threaded only on one or both ends and the threading covers 25 percent or less of the total actual length; and (2) stainless steel threaded rod, defined as steel threaded rod containing by weight 1.2 percent or less of carbon and 10.5 percent or more of chromium, with our without other elements. Excluded from the scope of the AD duty probe is any merchandise covered by the existing AD duty order on certain steel threaded rod from mainland China.

The USITC will issue its preliminary injury determination by 8 April (a vote has been scheduled for 5 April).
