Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Nature of Notice: Notice of scope rulings.

Summary: The DOC has published the following list of scope rulings completed between 1 October and 31 December 2017. Scope rulings serve to determine whether a particular product is within the scope of an AD and/or CV duty order. Scope issues typically arise in cases where the descriptions of subject merchandise contained in the DOC’s determinations are ambiguous. It is also possible that, as technology evolves and new products are created, these new products may fall outside the scope of the order.

Product: Wooden cabinets and vanities, classified under HTSUS subheadings 9403.40.9060, 9403.60.8081 and 9403.90.7080.

Nature of Notice: Initiation of AD investigation A-570-106 and CV investigation C-570-107, effective 27 March 2019.

Summary: The scope of these investigations covers wooden cabinets and vanities that are for permanent installation (including floor mounted, wall mounted, ceiling hung or by attachment of plumbing), as well as wooden components thereof. Subject merchandise is made substantially of wood products, including solid wood and engineered wood products (including those made from wood particles, fibres or other wooden materials such as plywood, strand board, block board, particle board or fibreboard), or bamboo. Wooden cabinets and vanities consist of a cabinet box (which typically includes a top, bottom, sides, back, base blockers, ends/end panels, stretcher rails, toe kicks and/or shelves) and may or may not include a frame, door, drawers and/or shelves. Subject merchandise includes wooden cabinets and vanities with or without wood veneers, wood, paper or other overlays, or laminates, with or without non-wood components or trim such as metal, marble, glass, plastic or other resins, whether or not surface finished or unfinished, and whether or not completed.

Wooden cabinets and vanities are covered by these proceedings whether or not they are imported attached to, or in conjunction with, faucets, metal plumbing, sinks and/or sink bowls or countertops. If wooden cabinets or vanities are imported attached to, or in conjunction with, such merchandise, only the wooden cabinet or vanity is covered by the scope. Subject merchandise includes the following wooden component parts of cabinets and vanities: (1) wooden cabinet and vanity frames, (2) wooden cabinet and vanity boxes (which typically include a top, bottom, sides, back, base blockers, ends/end panels, stretcher rails, toe kicks and/ or shelves), (3) wooden cabinet or vanity doors, (4) wooden cabinet or vanity drawers and drawer components (which typically include sides, backs, bottoms and faces), (5) back panels and end panels, and (6) desks, shelves and tables that are attached to or incorporated in the subject merchandise.

Subject merchandise includes all unassembled, assembled and/or "ready to assemble" wooden cabinets and vanities, also commonly known as "flat packs," except to the extent such merchandise is already covered by the scope of AD and CV duty orders on hardwood plywood from mainland China. It also includes wooden cabinets and vanities and in-scope components that have been further processed in a third country, including one or more of the following: trimming, cutting, notching, punching, drilling, painting, staining, finishing, assembly or any other processing that would not otherwise remove the merchandise from the scope of the investigations if performed in the country of manufacture of the in-scope product.

A range of products are excluded from the scope of these investigations, as detailed in the applicable notices of initiation.

The USITC will issue its preliminary injury determination by 22 April (a vote has been scheduled for 19 April).

Nature of Notice: Upcoming sunset reviews of AD duty orders A-570-914, A-570-990 and A-570-929 and CV duty 0rder C-570-915.

Summary: The DOC has announced that separate sunset reviews of the AD and CV duty orders on light-walled rectangular pipe and tube and the AD duty orders on pre-stressed concrete steel rail tie wire and small diameter graphic electrodes from mainland China will be initiated in May. The reviews will result in either the revocation or continuation of the orders.

Nature of Notice: Initiation of sunset reviews of AD duty orders A-570-848 and A-570-935 and CV duty order C-570-936,  effective 1 April 2019.

Summary: The DOC has initiated separate sunset reviews of the AD and CV duty orders on circular welded carbon quality steel line pipe as well as the AD duty order on freshwater crawfish tail meat from mainland China. The reviews will result in either the revocation or continuation of the orders.

Nature of Notice: Initiation of administrative reviews of AD duty orders, effective 1 April 2019.

Summary: The DOC has initiated separate administrative reviews of the following AD duty orders: hardwood plywood products (A-570-051) – period of review 23 June 2017 through 31 December 2018; multi-layered wood flooring (A-570-970) – POR 1 December 2017 through 30 November 2018; certain cased pencils (A-570-827) – POR 1 December 2017 through 30 November 2018; potassium permanganate (A-570-001) – POR 1 January through 31 December 2018; and wooden bedroom furniture (A-570-890) – POR 1 January through 31 December 2018. The DOC has also launched reviews of the CV duty orders on hardwood plywood products (C-570-052) for the period 25 April through 31 December 2018, and tool chests and cabinets (C-570-057) for the period 15 September through 31 December 2018. These reviews are scheduled to be completed by 31 January 2020 and could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the applicable period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the review.

Nature of Notice: Opportunity to request administrative reviews of AD/CV duty orders, effective 1 April 2019.

Summary: Each year during the anniversary month of the publication of an AD/CV duty order, finding or suspension of investigation, an interested party may request that the DOC conduct an administrative review of that particular action. The DOC is now giving interested parties the opportunity to request, by 30 April, administrative reviews of the AD duty orders on the following products from mainland China for the period 1 April 2018 through 31 March 2019: activated carbon (A-570-904), drawn stainless steel sinks (A-570-983), magnesium metal (A-570-896), non-malleable cast iron pipe fittings (A-570-875), stainless steel sheet and strip (A-570-002) and steel threaded rod (A-570-932). Parties may also request a review of the AD duty order on aluminium foil (A-570-053) for the period 2 November 2017 through 31 March 2019, as well as the CV duty orders on aluminium foil (C-570-043) for the period 14 August 2017 through 31 December 2018, drawn stainless steel sinks (C-570-984) for the period 1 January through 31 December 2018, and stainless steel sheet and strip (C-570-043) for the period 1 January through 31 December 2018. These reviews could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the reviews.

Nature of Notice: Postponement of preliminary determination in AD investigation A-570-092.

Summary: The DOC has decided to postpone its preliminary determination in this investigation from 8 April to 28 May. The preliminary determination will indicate whether the DOC is likely to establish AD duties on imports of subject merchandise.
