AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Polyvinyl alcohol, classified under HTSUS subheading 3905.30.00.

Nature of Notice: Final results of changed circumstances review in AD investigation A-570-879, effective 18 April 2019

Summary: The DOC has determined that Sinopec Chongqing SVW Chemical Co. Ltd. is the successor-in-interest to Sinopec Sichuan Vinylon Works for purposes of determining AD duty liability. The DOC will instruct CBP to assign entries of subject merchandise exported by the predecessor company the cash deposit rate applicable to the successor company (a de minimis rate) effective from 18 April.

Product: Uncovered innerspring units, classified under HTSUS subheadings 7326.20.0070, 7326.20.0071, 7326.20.0090, 7320.20.5010, 7320.90.5010, 9404.29.9005, 9404.10.0000, 9404.29.9010 and 9404.29.9011.

Nature of Notice: Final results of administrative review in AD investigation A-570-928, effective 18 April 2019.

Summary: The DOC has determined in its administrative review of imports of subject merchandise during the period 1 February 2017 through 31 January 2018 that Foshan Nanhai Jolyspring is not eligible for a separate rate and Comfort Coil Technology Sdn. Bhd. did not have any shipments of subject merchandise during the review period. For all mainland Chinese exporters of subject merchandise that have not been found to be entitled to a separate rate, such as Foshan Nanhai, the cash deposit rate will be the China-wide rate of 234.51 percent.

Product: Steel racks, classified under HTSUS subheadings 7326.90.8688, 9403.20.0080, 9403.90.8041, 7308.90.3000, 7308.90.6000, 7308.90.9590 and 9403.20.0090.

Nature of Notice: Amended preliminary affirmative determination in CV investigation C-570-089, effective 22 April 2019.

Summary: The DOC has amended the scope of its CV duty investigation of subject merchandise to conform with the scope of the companion AD duty investigation, including the exclusions of (1) decks, i.e., shelving that sits on or fits into the horizontal supports to provide the horizontal storage surface of the steel racks; (2) wire shelving units, i.e., units made from wire that incorporate both a wire deck and wire horizontal supports (taking the place of the horizontal beams and braces) into a single piece with tubular collars that slide over the posts and onto plastic sleeves snapped on the posts to create a finished unit; (3) pins, nuts, bolts, washers and clips used as connecting devices; and (4) non-steel components.

Product: Certain steel wheels 12 to 16.5 inches in diameter, classified under HTSUS subheadings 8716.90.5035 and 8716.90.5059.

Nature of Notice: Preliminary affirmative determination and preliminary affirmative critical circumstances determination in AD investigation A-570-090, effective 22 September 2019.

Summary: The DOC has preliminarily established the following dumping margins for imports of subject merchandise. The DOC will instruct CBP to begin collecting AD cash deposits on imports of subject merchandise at these rates. If both the DOC and the USITC issue affirmative final determinations in this case, the DOC will issue an AD duty order and require AD cash deposits at the rates specified therein, which could be different from those set forth below.

The DOC has also preliminarily determined that critical circumstances exist for Changzhou Chungang Machinery Co. Ltd. and the China-wide entity.

Product: Polyester textured yarn, classified under HTSUS subheadings 5402.33.3000 and 5402.33.6000.
Nature of Notice: Preliminary affirmative determination of critical circumstances in AD investigation A-570-097 and CV investigation C-570-098, effective 23 April 2019.

Summary: The DOC has preliminarily determined that critical circumstances exist with regard to all imports of subject merchandise. If the DOC makes an affirmative determination that countervailable subsidies have been provided at above de minimis rates, it will instruct CBP to suspend liquidation of all entries of subject merchandise that are entered, or withdrawn from warehouse for consumption, on or after the date that is 90 days prior to the effective date of any provisional measures. For such entries, CBP will require a cash deposit equal to the estimated preliminary subsidy rates established in the preliminary determination.

Nature of Notice: Postponement of preliminary determination in AD investigation A-570-097.

Summary: The DOC has decided to postpone its preliminary determination in this investigation from 6 May to 25 June. The preliminary determination will indicate whether the DOC is likely to establish AD duties on imports of subject merchandise.
