Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Certain crystalline silicon photovoltaic products, classified under HTSUS subheadings 8501.61.0000, 8507.20.8030, 8507.20.8040, 8507.20.8060, 8507.20.8090, 8541.40.6020, 8541.40.6030 and 8501.31.8000.

Nature of Notice: Court decision not in harmony with final results and amended final results of administrative review in AD investigation A-570-010, effective 4 August 2019.

Summary: The DOC has amended the final results of its administrative review of subject merchandise for the period 31 July 2014 through 31 January 2016 after the U.S. Court of International Trade sustained its remand redetermination. As a result, the DOC has issued amended dumping rates for the companies below. Aside from Shenzhen Sungold Solar Co. Ltd., none of the cash deposit rates listed below have been superseded by cash deposit rates calculated in intervening administrative reviews. Because Shenzhen Sungold Solar lost its separate rate in the most recently completed review of this order, the DOC has not revised its cash deposit rate.

Nature of Notice: Preliminary affirmative determination and postponement of final determination in AD investigation A-570-104, effective 25 September 2019.

Summary: The DOC has preliminarily established the following dumping margins for imports of subject merchandise. The DOC will instruct CBP to begin collecting AD cash deposits on imports of subject merchandise at these rates. If both the DOC and the USITC issue affirmative final determinations in this case, the DOC will issue an AD duty order and require AD cash deposits at the rates specified therein, which could be different from those set forth below. CBP will not assess AD duties or impose cash deposit requirements on entries subject to a zero rate.

The DOC has also postponed its deadline for a final determination in this investigation until 7 February 2020 and extended the provisional measures from a four-month period to a period no greater than six months.

Nature of Notice: Notice of scope rulings.

Summary: The DOC has published the following list of scope rulings completed between 1 October and 31 December 2018. Scope rulings serve to determine whether a particular product is within the scope of an AD and/or CV duty order. Scope issues typically arise in cases where the descriptions of subject merchandise contained in the DOC’s determinations are ambiguous. It is also possible that, as technology evolves and new products are created, these new products may fall outside the scope of the order.

Summary: The DOC has rescinded its administrative review of subject merchandise exported by Xuzhou Constant Forest Industry Co. Ltd. during the period 1 January through 31 December 2019 based on the timely withdrawal of the review request. As a result, the cash deposit rate for subject merchandise from this company will continue to be the rate established in the most recently completed administrative review.

Summary: The DOC has corrected the 30 July final results of its administrative review on subject merchandise for the period 1 December 2016 through 30 November 2017 to clarify that Wuxi Suntech Power Co. Ltd./Luoyang Suntech Power Co. Ltd. Summary: Each year during the anniversary month of the publication of an AD/CV duty order, finding or suspension of investigation, an interested party may request that the DOC conduct an administrative review of that particular action. The DOC is now giving interested parties the opportunity to request, by 31 October, administrative reviews of the AD duty orders on the following products from mainland China for the period 1 October 2018 through 30 September 2019: barium carbonate (A-570-880), barium chloride (A-570-007), boltless steel shelving units pre-packaged for sale (A-570-018), certain cut-to-length carbon steel (A-570-849), electrolytic manganese dioxide (A-570-919), helical spring lock washers (A-570-822), polyvinyl alcohol (A-570-879) and steel wire garment hangers (A-570-918). Parties may also request a review of the CV duty order on boltless steel shelving units pre-packaged for sale (C-570-019) for the period 1 January through 31 December 2018. These reviews could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the reviews.

Summary: In the final results of its administrative review for the period 1 August 2017 through 31 July 2018, the DOC has determined that High Den Enterprises Ltd. is not eligible for a separate rate and is therefore part of the China-wide entity, subject to a 77.57 percent rate.
