AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Circular welded austenitic stainless pressure pipe, classified under HTSUS subheadings 7306.61.5000 and 7306.61.7060.

Nature of Notice: Final results of expedited sunset review in AD investigation A-570-930, effective 2 October 2019.

Summary: The DOC has determined that revocation of this AD duty order would likely lead to continuation or recurrence of dumping. The USITC will proceed with its own investigation to determine whether revocation would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. The order will be extended for an additional five years if the USITC issues an affirmative determination but will be rescinded if the USITC issues a negative determination.

Summary: The DOC has determined that revocation of this CV duty order would likely lead to continuation or recurrence of countervailable subsidisation. The USITC will proceed with its own investigation to determine whether revocation would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. The order will be extended for an additional five years if the USITC issues an affirmative determination but will be rescinded if the USITC issues a negative determination.

Product: Circular welded carbon quality steel line pipe, classified under HTSUS subheadings 7306.19.1010, 7306.19.1050, 7306.19.5110 and 7306.19.5150.

Nature of Notice: Continuation of AD duty order A-570-935 and CV duty order C-570-936, effective 2 October 2019.

Summary: The USITC determined on 5 September that revocation of the AD and CV duty orders on subject merchandise would likely lead to continuation or recurrence of material injury to an industry in the U.S. within a reasonably foreseeable time. Accordingly, the DOC has extended the orders for an additional five years.

Product: Uncovered innerspring units, classified under HTSUS subheadings 7320.20.5010, 7320.90.5010, 7326.20.0070, 7326.20.0071, 9404.10.0000, 9404.29.9005, 9404.29.9010 and 9404.29.9011.

Nature of Notice: Preliminary results of administrative review in AD investigation A-570-928, effective 2 October 2019.

Summary: In its review of subject merchandise for the period 1 February 2018 through 31 January 2019, the DOC has preliminarily determined that neither of the two companies under review (Jietai Machinery Ltd. (HK) or Green Asia Parts LTD.) have demonstrated their eligibility for a separate rate. If these results are finalised, these companies will be considered part of the China-wide entity, subject to a 234.51 percent AD rate.

Nature of Notice: Initiation of administrative reviews of AD/CV duty orders, effective 7 October 2019.

Summary: The DOC has initiated separate administrative reviews of the following AD duty orders for the period 1 August 2018 through 31 July 2019: certain passenger vehicle and light truck tyres (A-570-016), certain steel nails (A-570-909), laminated woven sacks (A-570-916) and polyethylene retail carrier bags (A-570-886). The DOC has also launched reviews of the AD and CV duty order on cast iron soil pipe fittings (A-570-062 and C-570-063) for the periods 20 February 2018 through 31 July 2019 and 19 December 2017 through 31 December 2018, respectively, as well as the CV duty orders on certain passenger vehicle and light truck tyres (C-570-017) and laminated woven sacks (C-570-917) for the period 1 January through 31 December 2018. These reviews are scheduled to be completed by 31 August 2020 and could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the applicable period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the review.

Product: Wooden cabinets and vanities and components thereof, classified under HTSUS subheadings 9403.40.9060, 9403.60.8081 and 9403.90.7080.

Nature of Notice: Preliminary affirmative determination in AD investigation A-570-106.

Summary: The DOC has preliminarily established the following dumping margins for imports of subject merchandise. The DOC will instruct CBP to begin collecting AD cash deposits on imports of subject merchandise at these rates. If both the DOC and the USITC issue affirmative final determinations in this case, the DOC will issue an AD duty order and require AD cash deposits at the rates specified therein, which could be different from those set forth below. CBP will not assess AD duties or impose cash deposit requirements on entries subject to a zero rate.
