AD/CV Notices

Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Various products.

Nature of Notice: Initiation of administrative reviews of AD duty orders, effective 11 December 2019.

Summary: The DOC has initiated separate administrative reviews of the AD duty orders on electrolytic manganese dioxide (A-570-919), polyvinyl alcohol (A-570-879) and steel wire garment hangers (A-570-918) for the period 1 October 2018 through 30 September 2019. These reviews are scheduled to be completed by 31 October 2020 and could result in (a) revised AD duty assessments for entries of subject merchandise made during the applicable period of review and (b) revised AD duty cash deposit rates for entries made after completion of the review.

Nature of Notice: Final results of administrative review in AD investigation A-570-045, effective 12 December 2019.

Summary: The DOC has established the following dumping margin for imports of subject merchandise during the period 4 November 2016 through 30 April 2018. CBP will assess AD duties on all appropriate entries using this rate, which will also be used to determine new AD cash deposit requirements.

Nature of Notice: Amended final results of administrative review in AD investigation C-570-980, effective 13 December 2019.

Summary: The final results of this review, which covers the period 1 January through 31 December 2016, were published on 28 August. One party subsequently submitted ministerial error allegations and the DOC has decided to make certain changes to the final subsidy rates for Jinko Solar as well as the companies for which a review was requested. The DOC will instruct CBP to collect CV cash deposits on imports of subject merchandise at these amended rates.

Nature of Notice: Preliminary results of administrative review in AD investigation A-570-918, effective 13 December 2019.

Summary: In its administrative review of subject merchandise for the period 1 October 2017 through 30 September 2018 , the DOC has preliminarily determined that Shanghai Wells Hanger Co. Ltd. and Hong Kong Wells Ltd. have failed to demonstrate their eligibility for separate rate status. If these results are finalised, these companies will be considered part of the China-wide entity and will therefore be subject to a 187.25 percent rate.

Nature of Notice: Initiation and preliminary results of changed circumstances review in AD investigation A-570-040, effective 13 December 2019

Summary: The DOC has preliminarily determined that Sailun Group Co. Ltd. is the successor-in-interest to Sailun Jinyu Group Co. Ltd. and that Sailun (Shenyang) Tire Co. Ltd. is the successor-in-interest to Shenyang Peace Radial Tyre Manufacturing Co. Ltd. If the preliminary results are adopted as final, the DOC will instruct CBP to assign entries of subject merchandise exported by the predecessor company the cash deposit rates applicable to the successor company effective from the date of publication of the final results.

Nature of Notice: Notice of scope rulings.

Summary: The DOC has published the following list of scope rulings completed between 1 January and 31 March 2019. Scope rulings serve to determine whether a particular product is within the scope of an AD and/or CV duty order. Scope issues typically arise in cases where the descriptions of subject merchandise contained in the DOC’s determinations are ambiguous. It is also possible that, as technology evolves and new products are created, these new products may fall outside the scope of the order.

The DOC has also corrected a scope ruling issued on 11 December 2018 to indicate that certain fire-protection weld outlets are within the scope of the AD duty order on carbon steel butt-weld pipe fittings.

Nature of Notice: Preliminary results of administrative review in AD investigation A-570-904, effective 17 December 2019.

Summary: The DOC has established the following dumping margins for imports of subject merchandise during the period 1 April 2017 through 31 March 2018. CBP will assess AD duties on all appropriate entries using these rates, which will also be used to determine new AD cash deposit requirements.
