Additional Safeguard Duty Imposed on Butter and Fresh or Sour Cream

The U.S. Department of Agriculture’s Foreign Agricultural Service is imposing for the period 5 October through 31 December a special safeguard duty on butter and fresh or sour cream containing more than 45 percent by weight of butterfat. This additional duty will be 54.9 cents per kilogramme on imports entered under HTSUS subheadings 0401.50.75 and 0403.90.78 and 51.4 cents per kilogramme on imports entered under HTSUS subheading 0405.10.20. FAS is imposing these measures, as allowed under Article 5 of the World Trade Organisation Agreement on Agriculture, after determining that imports of subject products have exceeded the 2015 trigger level of 9,414,976 kilogrammes.

FAS notes that goods of U.S. free trade agreement partners Canada, Mexico, Jordan, Singapore, Chile, Australia, Morocco, El Salvador, Honduras, Nicaragua, Guatemala, Bahrain, Dominican Republic, Costa Rica, Peru, Oman, South Korea, Colombia and Panama are not subject to this safeguard duty. In addition, this duty will not apply to any goods en route on the basis of a contract settled before 5 October.
