Brazil Suspends New Procedures to Provide Duty Relief to IT and Capital Goods

The Brazilian government has suspended the application of a recently issued regulation (Directive 309/2019) setting forth new administrative procedures to analyse requests to add new items to the Ex-Tarifario list, which provides duty-free or reduced duty treatment to foreign capital goods and information technology and telecommunications products with no domestic production. The new regulation has been criticised by domestic industry interests, which allege that it permits the addition of used goods to the Ex Tarifario list and includes certain additional parameters to compare the equivalency of foreign and domestic goods, such as price and delivery times.
