EPA Releases First Major Update to Chemicals List

The Environmental Protection Agency recently released an update of the Toxic Substances Control Act inventory listing the chemicals that are actively being imported, manufactured and processed in the United States. A review of the inventory was one of the requirements of the Frank R. Lautenberg Chemical Safety for the 21st Century Act enacted in 2016, the first significant overhaul of TSCA since its enactment in the 1970s.

According to this update, only 47 percent of the 86,228 chemicals on the inventory are currently in commerce. The EPA states that this finding will help focus its risk evaluation efforts on chemicals that are still on the market. The EPA adds that more than 80 percent of the chemicals in commerce (32,898) have identities that are not confidential business information. For the rest, the EPA is developing a rule outlining how it will review and substantiate all CBI claims seeking to protect the specific chemical identities of substances on the confidential portion of the TSCA inventory.
